A car garage next to my flat has been dumping cars in front of my block of flats when customers are not paying up or returning for their cars. We've had one broken down van infront for over a year (it still had tax) which is now finally gone but it has now been replaced by two broken down cars which is taking up more space.

I will speak to the garage about this but is there anything I can do in regards to the vehicles that keep getting dumped in front of the flat?

You could phone up the Council and report them as abandoned

Is there a management company who deals with your flats and communal areas? It may be worth speaking to them to explain the situation - maybe they can do something more formal in terms of the garage seeing as it's probably their land the cars are being dumped on.

Push them away so that they are in front of the garage

Is there any restrictions on parking?
Are the cars road legal?
Are they blocking access to any drives / paths / garages?

Only on PH would someone first make a thread and then talk to the offending garage second.

If it's a public road and the vehicles are taxed & insured then nothing you can do. Anyone can park there.

In Windermere, there was an issue a few years back, where an individual was leaving 3 or more cars for sale in a layby on the A591 out of the town.

Somebody on PH kindly gave us pointer towards some environment legislation IIRC, that allowed us to get it stopped, as they were using a public road as part of a business.
They all got moved when the district council slapped an enforcement notice on them.

Does this ring any bells with any of the legally competent posters here?

I never said there was a restriction on parking, cars were not road legal or blocking access to anywhere. If they did I would've have said so. If they had breached any of these I would have sorted it out myself. However as they do not breach any of these I am curious if there's any rules for garages to provide duty of care for customers cars etc.

This wont be fun for you OP.

A lot of PHers live in roads where parking is minimal and consequentially have a bit of an obsessive 'thing' going on about anyone who parks outside their own house.

BTW. Has anyone else mentioned that YOU don't own the road outside your house yet?

AFAIK, that only applies to a garage / person acting in the business of selling motor vehicles.

I am aware nobody owns the roads, that wasn't my query or my point. I have allocated parking for my cars so it doesn't impact me being able to park. My post was in response to a business abandoning customers cars on the road and pavements outside the flat.

They're not abandoning them, they're parking them there. If road legal tax insurance etc then no issues. If they're working on them on the street or advertising them for sale then that comes under environment act.

Though not if, in doing so, an obstruction is caused.

Yes obviously if no parking restrictions or obstruction too.

The car that's parked on the pavement has had no road tax since May. It's been reported to DVLA months ago but still hasn't been shifted. It'll be around the 4th of 5th vehicle that's been dumped on the streeet to await DVLA to clamp and towed away.

Surprised it's been that long. DVLA seem very keen on clamping around here. Having said that, one car was clamped and then still sat there for 5 - 6 weeks!

My lad is in a street that had a local garage/MOT station park a lot of cars to the exclusion of parking space for residents.

They got 'Residents only' status in the whole street - don't know how - but sorted the problem.

I am not anti the garage - I get my MOTs done there for both motors...
