A driver is refusing to pay a £100 parking fine following a blunder over meters.

Campbell MacEachern, (50), originally from Coalsnaughton in Clackmannanshire, now lives in Stroud in Gloucestershire.

During a holiday to visit family last month, he parked at the Rainbow Slides car park. When he went to pay the £2.50 fee the parking meters were out of order.

Now he has been sent a threatening letter demanding £100 from the firm who operates the car park, Excel Parking.

Campbell said: “I was up visiting my uncle. On July 26 I parked when I was going to the station to pick up my son.

“I went up to the machine to pay and it and it wouldn’t take any money. There was a laminated sign saying if both machines are out of action then park for free.
Same thing happened to someone I know.

I've been in car parks many times over the years where a machine has refused to take my money. I've never seen a sign though.

If none of the other machines in the car park are working, I just write 'Machine out of Order' on a scrap of paper and put it on my dash top.

To date, I have never had a ticket. (For that particular issue anyway).

The newspaper article has been posted on Facebook and it looks as if a lot of people have been caught out by this.

We had problems in local car parks with payment machines not working , the local authority then insisted that if the machines don't work make payment via mobile phones .
Only problem is it's a seaside town ,one of the closest to France and unless you are with certain service providers you don't have a signal and many have very limited data connections .
Not everything works like it does in the big cities.

The best thing to do in SCOTLAND but not England in these cases is to ignore any threatograms as the PPC can only chase the driver if the parking is in Scotland. It doesnt matter where the driver/RK lives

ergo when they write to the RK requesting that they name the driver, just write back saying the the RK has no legal obligation to do so ,and if the PPC want their speculative invoice paid to chase that person. Trouble is the first thing these people do is to use the word 'I' as in 'I drove into' instead of 'The driver did this' or the driver saw that. By owning up to the fact that they were the driver the PPC can chase them, Even better if the insurance has 'any driver or named driver on the policy as the PPC cannot use the balance of probabilities that the RK was also the driver

Worth looking at the situation in Scotland on Pepipoo.com

So in effect you can park in any car park in Scotland ( except council run ones) that has signs saying operated by Parking Eye Europarks , Excel and other nefarious operators and not pay a penny!!!!

Sometimes Scottish law is a little bit more savvy than the English equivalent

What are people who don't own a mobile phone supposed to do?

A Google search shows that there have been problems at that site ever since Excel were brought in to 'manage' it in 2014.

Probably a case brought by Microsoft. (Oxymoron: Microsoft Works)
