So booked a b&b with parking for 2 weeks near Gatwick 5 months ago, 4 adults, 2 rooms, supposed to be checking in on the 17th and received a call tonight that they where having some plumbing work done and it was doubtful we would have rooms. Told 50/50 but he didn't want to mess us around. A quick look on booking.com shows they have plenty of rooms on the 16th and 18th but full on Saturday.
I'm 100% sure he's overbooked, (he encouraged us not to use booking.com but do it direct, so he probably forgot to take the rooms off). At the time we booked cheap parking and rooms where available now they are not and I'm pissed off with his lying. Would i be able to claim the difference in hotel now £330 vs then £120 (yeah i know its probably a st hole but). If i can be arsed to do it is another story but i just wondered legally if hotels can just pull the booking with no penalty, if i canceled at any point i would have been charged the full amount.
Thoughts please.
cheers

stty situation, particularly with only a few days to go befor you travel.

What do the hotel's T&C's say on the subject of cancelled bookings and non aviailability of booked rooms?

i think you've it it on the head, hes took a booking and before hes been able to make the room unavailable you've booked online.

I would speak to booking.com and see what they are going to do to sort this out.

They aren't interested as effectively he is their customer not me , they take their money from him.

I had a similar thing with booking.com. Booked a stay, then booking.com came back within a day or so to say it was overbooked.

They tried to find an alternative but there was nothing suitable. I didn't ask for it but in the end they paid me £40 for the inconvenience, even though I wasn't too bothered, it was a weekend away that could easily be rearranged. Subsequently we did get to the place.

Kind Regards,
I've had similar situations and managed to get recompense from the hotel. It is, sadly, not uncommon.

My line of argument is thus (but remember this is not legal advice but a negotiation approach - IANAL):

It appears that the hotel itself says this is an unbreakable booking. They have accepted your booking (through their agent Booking.com) and you have accepted that a no show would incur cost to you in any circumstance. This, and the fact that you have authorised a deduction from your card, would suggest that you and they have gone firm and that you have formed a contract.

On the face of it, therefore, I'd tell the hotel that I'd be willing to go Small Claims for the difference between what you end up paying and what you agreed with the hotel, provided that the substitution is reasonably comparable. That, after all, is the loss you've been made to absorb.

That would be the starting point in any discussion I'd have with the hotel.

My experience is that they generally pay up as a gesture of goodwill and refuse to accept that they have done anything wrong.

BTW - get screen shots of the web pages showing availability...

This.
IANAL but a contract must work both ways or it becomes unenforceable. If you accept their terms on "no refunds" then they are implying that as you've paid your room is guaranteed.
Your contract, is it with booking.com? If so it's up to them to make good on their end. Don't agree to pay a penny more if they claim it's an upgrade.

As I read it, the OP booked direct with the hotel as encouraged by the owner of the hotel and not through Booking Direct.
I'd be telling the hotel to find me alternative accommodation, and not paying a penny more.

Same happened to me through booking dot com, but it was 5*, they owned up to the mistake and paid for an alternative which was triple the cost can only fault them that we had to pay cash on arrival and then claim it back later, couple of stressful weeks that was waiting for a £2000 reimbursement.. Can see why the villa was worth that much it was amazing.

Direct with the B&B OP cant see you having any chance.

Sorry, I'm being dim here...

You've booked a fortnight's stay in a B&B for 4 adults across 2 rooms and parking, near an airport for £130 all in?
£2.32 pppn?

What's actually happened?

I'd imagine more likely OP has booked one night at a B&B plus a fortnight parking for a holiday.

YES 1 nights stay, and planning on that being as short as possible (under 8 hours).
An update, i called him up and told him i thought his story was BS, he flipped his lid and told me to drive up and I can see for myself. I cant be arsed doing that as it a 80 mile drive, and one of the group going has found a deal for £160, so only £30 out of pocket. Chalk it up to experience and will be leaving a less than complimentary review on google and TripAdvisor, to be fair his reviews are a mixed bag anyway so i doubt he will care, hes at the cheapest end, and we only booked it for a laugh because we where genuinely curious to see what it was like. (much to the disgust of our other half's). Lifes to short and i will be in Mexico having a beer on the beach in less than 3 days so........

You could always pop in when you get to Gatwick and see what you could have had....

People dont tend to realise how cheap you can get a limo to the airport, if it is 80 miles and there is four of you, you could book an S class merc to pick you all up from home the morning you fly and deliver you to the terminal for about £100 each way? Leave the car at home and sleep in your own beds!

Airport car services are cheaper than most people think, particularly when you factor in car park charges.

Did look at the taxi option , (didn't think of limo) it was about £110 each way. The only thing is we have a 9am flight so be up at silly o'clock! We really did book it for a laugh, (well the boys did) in the past I normally try for stanstead flights and stay at the Hilton because you can walk to the terminal. Staying in st hotels is a bit of a private joke between me and the other bloke going. We had quite a few beers at the time of booking, a decent hotel and parking would have been about £450, and probably a wise investment, especially compared to the cost of the bloody holiday,
