So I received a penalty notice from Premier Park Ltd.
I was parked in a pub car park and purchased a 3 hour ticket. Nearly 3 hours are up but kids still enjoying the day so purchased another 1 hour ticket.
Nearly 4 weeks later I get the pcn with entry/exit photos saying I was in the car park for 4 hours 17 minutes. My penalty is £100 or £60 if paid within 2 weeks.
I call the pub and am told that they give 15 minutes grace to find the space,park,get ticket and leave.
I argue that in that case as I purchased 2 tickets surely I should have 30 minutes grace.
They look into my purchases and they overlap , premier park have reduced my fine to £20 if paid within 6 days, £100 if not!
The crux is that if I had driven out and back into the car park and purchased the 2nd ticket I wouldn’t have received a fine.
Would you pay the £20 or contest direct with the parking company?

Whatever you do, I would also be telling the pub I won't be going there again and the reason why...

I can honestly say say I have never been to a pub that charges to park - in fact I cannot even remember seeing a pub that charges its customers to park ? why would you even go to one that does ?

After 4 hours and 17 minutes in the pub, I think you should just be glad you didn't get pulled over on the way home smile

On a serious note, just pay the £20. The penalty is probably enforceable, but even if not, it's not worth the grief fighting it.

For £20, pay it - not worth your time/hassle fighting it I suspect.

But yes - go back to the pub and tell them their parking company are taking the mickey and you're unimpressed...

If its a penalty then its never enforceable whatever the situation. Find out the chances of them starting legal action and do what you think is best. Personally I would never pay it and would certainly never go to that pub again.

I suspect that you might have missed the outcome of Parking Eye v Beavis.

I have no legal background, but personally I would send them a letter for the amount I owe, with a full explanation, bulletpointed(numbered) reasons, and a timeline which should they take you to court would form the basis of your defense.
No fluffy nonsense, just factual points.

Unfortunately the argument that OP has already presented amounts essentially to "it's not fair". And that doesn't hold much weight in a legal defence.

A legal defence would be based around the fact that OP wasn't in breach of contract (he was) or perhaps that the charge was unenforceable because it was there was no legitimate interest that the imposition of the charges protected (there almost certainly was) or that the level of the charge was disproportionate to the protection of that interest (it almost certainly wasn't).

It's £20 for goodness sake. It would have been £60 so OP's already done well. Time to pay up, before it goes back to £60 or £100 and move on with life.

Chances are that there's a lack of free Public car parking in the vicinity and "some" people will have been parking in the Pub's car park for free, rather than have to pay for parking elsewhere. As a result the landlord's probably got pee'd off and signed up with Premier Park.

Given that OP has admitted he's gone over the time limit I'd hold up my hand and pay.

There are lots of them depending on what is in the surrounding area. The Varsity on the outskirts of Warwick Univeristy because you could park and go to uni for the day, the queen and castle and the Clarendon arms in Kenilworth that are opposite the castle so you could park and avoid the castle parking charge are just three that spring to mind.

Beavis said that some charges may be commercially justified not that penalising people is ok. Personally I think the commercial justification was a load of old bks as well. I could set up a company sending out spurious demands and if people didn't pay me I would go bust so its commercially justified for people to pay me.

There is usually a notice that says, maximum stay X hours, no return with Y hours. I think you fell foul of the no-return within Y hours.
As others have said, I have never seen a pub with a paid for car park, commercial suicide, I would think. The only situation may be in a crowded town centre near major shops or railway station (to discourage commuters), or in a busy tourist area.

Trouble is, that he was in the pub that the carpark was for the whole time. Some pubs have the parking charge credited to any bill when you eat in there.

We were on a day trip and used the car park as the council one adjacent was packed. We saw the camera on entering but assumed these were to deter people from not paying for a ticket.
My Mrs daughter is pissed off as her company car was also pcn'd but her company just paid the fine and deducted the £60 from her wages.
Have since found out , through TripAdvisor, that yes the carpark had been mis-used but also that the owners couldn't give a flying fk about people who get caught unawares by the parking charges.
We also could have had £3 of the parking charges refunded if we purchased drinks in the pub ...but it didn't look particularly inviting.

Here a response the owner has left to a disgruntled patron , which sums it all up really.

"You obviously never read the signs you Moron you get your money back when you order food and drink.
This proves we tell everybody to pay for their parking. Plus 18 sighns.
Twisted your ankle walking back of course theres light on the access road and car park.
Dont want Morons in my pub stay away.
Best thing Ive introduced to keep car park miss use away"

And this statement is obviously not true.
"does'nt matter if you stayed 10 to 15 minutes before getting a ticket you are allowed as long as you don't overstay your time if you do get another and get your money back its a no brainer.

1) register on pepipoo.com
2) go to the private parking thread
3) put all this up BUT DO NOT say, mention,infer or even suggest who was driving
4) just say the drivar paid this,... the driver did that.. etc

5) tell then whole truth and do not fudge or lie or bend the truth
6) if you do you will be dropped like a hot spud, the guys on there do not like chancers
7) do some resarch yourself on the company and how they operate, they guys will appreciate that rahter than you sitting on your backside wanting to be hand fed
8) follow to the letter what they tell you to write and when to write it
9) they dont guarantee wins but at least 90% of the cases get sorted in favour of the poster

You parked in the pub car park and didn't use the pub?
