Wasn't going to bring this up but seeing as it's a bloody miserable day, I'm in that mood...

The other night I was driving through North London say about 8ish, not speeding, I'm doing about 25ish and approaching some lights with a stupid idiot right up my ar$e, the lights turn to amber so I speed up to say 30 to get through them, didn't wanna risk braking for the idiot behind me and causing an accident.

Few seconds later past the lights, Police in Starsky & Hutch style racing up behind me, lights flashing and on the other side of the road. I pull over and...

WPC "Can you get out the car"
Me "What have I done wrong?"
WPC "That's a very nice car you have"
Me "Thank you"
WPC "Are you in a rush?"
Me "No, was I speeding?"

Young PC comes over to me all flash and stubborn.

PC "Why did you go through the lights?"
Me "It wasn't red, it was amber and I had some idiot right up behind me"
PC "Have you read the highway code?"
Me "Yes"

All short and sweet cos I knew he just had it in for me.

PC "You've been stopped for reckless driving in this car before haven't you?"
Me "NO!!, you're joking right??"
PC "Are you sure?"
Me "Well it must have been this incident. Marked car was following me once whilst I was warming up the car, wasn't speeding, Sunday afternoon, plenty of people around, taking it easy warming up the car. I stop and cos it's an F1 gearbox, sometimes it can come out of gear and go into neutral, so as I pull off thinking it was in gear, it wasn't so it rev'd a bit. Twit pulled me over and said whether I could drive it or not. I said of course, would you like me to show you??"

PC "What's your name and address"

I told him the correct details, he said goodbye, she was laughing at him, I drove off thinking what a tt!! Not even an apology or proper reason to pull me over like I was a wanted man or something.

My questions for the BiB on here are;

1). Did I break any laws by going the through the lights in amber in this case?
2). Why am I on a database as a reckless driver cos that PC thought I couldn't drive properly, isn't this false info on me?

Makes you laugh that they had nothing better to do what with all the crime taking place in London every second of the day. I would understand if they approached me in a decent manner without taking the p!ss outta me to check it wasn't stolen!!

Stupid question really.

Of course you are a criminal in the eyes of that officer. You obviously have a far higher income than the officer who stopped you and drive a nice car.

Now stop whingeing and go buy yourself a Kia Pride and start earning less money.

Amber means STOP!
You have a defence though if you continued through on amber to avoid a collision!

Only you and the officers who initiated the report which got what is called in my force an 'AV marker' on your car know the reasons why!
As they are not here to explain, we have to treat your explanation with some conjecture

Thanks gone. So in my case I was not breaking the law as I would have caused an incident if I had braked to make the stopline.

With regards to the 'AV marker' you call it, how would he have known I was stopped for reckless driving if he didn't even know who I was?? He asked for my name and details at the end of the conversation/s. Would this info be on the veh reg number or the driver? Maybe some while back, the previous owner had been done for reckless driving on that reg number.

Shame they didn't stop the lunatic in the most probably unroadworthy, out of MOT piece of sh!t that was trying force his nose into my ar$e

The vehicle registration number is put onto PNC with an AV marker (associated vehicle) with an information report about what the vehicle may have been involved in.

This may be anything from vehicles used in crime to isolated incidents involving suspect or bad driving!

Regardless of who was driving at the time of the incident which attracted the AV marker, the information may include who was drivng at that time but the point is to flag a vehicle either used in crime or used in an anti social manner.

There is a power under Section 53?? Police Reform Act 2002 which allows a police officer to impose a warning about anti social use of the vehicle. This warning lasts for a year. If the vehicle is seen again being used in an anti social way or being driven off road where it should not be, then Police can seize the vehicle! A PNC check will reveal any AV about what the vehicle has been up to in the recent past!!!

This is similar legislation to Harassment Alarm Distress, Section 5 Public Order 1986.

A warning is given to stop the relevant unacceptable behaviour. If it happens again, then a power of arrest is activated.

I expect the officers in the Amber light incident PNC'd your vehicle and were told that there was an AV marker on it. They will then have asked what that was about.

So basically Big T you appear to be within the guidelines of the highway code my friend, seeing as you were clearly attempting to avoid an accident.

What a scary bit of information gone.

Seems to me this allows completely arbitrary and unchecked (I'm, assuming any individual officer can make these without corroboration/evidence?) comments (which could be COMPLETELY unfounded) to go on a record that could ultimately lead to very unsavoury consequences for the individual concerned.

Do you have to advise an individual that you are making this AV marker at the time?

Can they appeal?

Under the Data Protection Act and Freedom of Information Act respectively, are you restricted on who that information can be released to and am I allowed access to what you have on me?

How many more rights/laws like this are out there (but tucked away from ready public consumption) where I as an individual can be "marked" by a potentially unscrupulous copper in a situation where I simply disagree with them?

Very, very scary precedents being set with this kind of stuff. The more I learn about the Big Brother direction of this state the more I despair.

My view also S WORKS.

I was well p!ssed off with the attitude this copper gave me and not even an excuse to pull me up. He didn't explain that the car reg number was down for reckless driving and not me. I was treated like a criminal and spoke to like I was a kid.

I gave him attitude back though and made comments about the car's techinal ability so he wouldn't know what the I was talking about, the jealous twit. They knew I wasn't having it and at one point I think I said to him "look, if I've done something wrong then book me and stop wasting my time" Something like that anyway.

I have never been told about the car being tagged by any police person. I wonder if some copper has seen or heard the car about, got jealous and tagged it...Bet they can do that.
