Legality of works carpark bollard
Discussion
At work we have a bollard to control access to the carpark to stop
s using it. Workers from the company who we share the carpark with who installed the bollard have remotes to open it, whereas only a few employees of my company have remotes. The rest of us have to phone the bollard using our mobile phones to get the bollard open. Now in my mind this is now illegal unless you turn the ignition off and have the handbrake on which is not ideal, as previously you would call it as you came round the corner so you didn't have to wait for it to lower.
Am I right in thinking that we should now all be assigned remotes, rather than using a now potentially illegal method of entry?

Have you not got handsfree/bluetooth so you can call legally?

My hands free is connected to my personal phone, not my company phone.
What make is your company phone? I don't heed a hands free kit to operate my phone hands free. Also what your describing as illegal, is your choice.

Your beef is that you don't have a remote, where as other in your company do.

No law has been broken by the company, just use a hands-free phone (like I'm sure everybody else does) or speak to HR and get a remote. Simple.

Can you not open the window and just speak to it?
No, I get to work before the support team are in to answer.98elise said:

iPhone, I use the voice dialling by pressing the home button, but interacting with the phone in this manner is still illegalThe Surveyor said:

Not at all, been fine with it for the year or so I have been here, the legality just occurred to me the other day and thought I would ask about itNo law has been broken by the company, just use a hands-free phone (like I'm sure everybody else does) or speak to HR and get a remote. Simple.

This will be governed by the lease under which you have rights to use the car park - refer it to the landlord.
That is the other company I mentioned. They refuse to give us any more remotes for some weird reason. Dunno why they didn't just install number plate recognition to start with tbh.HappyMidget said:

It is if it's mounted within the wiper sweep, which is illegal. Plus it makes you look like an Uber driver, which is much, much worse a crime.
Use a dash mat instead... It might then be slightly obscuring the wiper sweep, but as it isn't screen mounted, I assume it wouldn't fall foul of legislation.Gassing Station | Speed, Plod & the Law | Top of Page | What's New | My Stuff
