S172 Appeal in Crown court

Hi all,

Has anyone been to crown court for section 172 conviction? how did it go and what to expect when applying for appeal. I have also appealed to magistrate court to reopen my case on the bases that paperwork was only served fifteen minutes prior to trial.

Can anyone advice in this matter?

The barristers' cab rank rule doesn't apply to direct access cases. I'm just saying.

Agtlaw didn't get back to you after you've called him a few times, really?

I called him behalf of two friends who did something stupid earlier in the year.

He got back to me the same day, was generous with his time and couldn't have been more helpful.

I think the OP is looking for online advice rather than a proper conversation with a legal bod wink

On your other thread, you were told that the Crown Court is the appropriate venue for your appeal. Is there any particular reason you ignored that and thought it appropriate to make a (ridiculous and time-wasting) application to the Magistrates’ Court?

I think, it wasn't fair of them that they were allowed to present papers fifteen minutes prior to trial. Do I lose anything by doing so?

And does anyone know, if it is possible to make a plea deal in crown court as now i know that many people do that.

They should make you pay the costs of the time wasted dealing with your hopeless application, but unfortunately that’s unlikely to happen.

The remedy at the time was an adjournment. Your counsel advised you to apply to adjourn. You ignored that as apparently you were hoping to save money on legal fees. You were convicted and now ask the convicting court to look at the late service issue.

I seriously doubt that the court will list an application to re-open. If it is listed then good luck. Good luck finding someone to advise you, as I’m out.

Have you tried Saul Goodman , attorneys at law, I've heard he is good with cases like this?

I'd be inclined to side with agtlaw on this, would you believe it?

Attempting to go down the route you outline should be fruitless and the courts shouldn't be cluttered up with such matters imo

As I see it, you were caught speeding.
Assuming your car is registered properly, you would have received some of the below:

A form to ask for the drivers details
An offer to pay a Fixed £100 Penalty or go to Traffic skool
Court proceeding papers
Notice to pay a biggererer fine or risk a CCJ
Attachment of earnings details

Did every single document go missing?

You then paid for legal assistance, but ignored their advice for an adjournment.
You then ignored the free advice on this post regarding the venue for appeal.

Exactly what would you like the answer to be?
