Are temporary roadworks speed limits enforceable if the workforce haven't bothered to cover or remove the old signage?

Driving down a dual carriageway which is usually a posted 40. You then hit roadworks and all the accompanying road works signage including big 20 or 30 mph signs and a lane closure and merge in turn etc.... As you progress through this section of road, there are more giant 20 or 30 signs dotted around but the original 40 repeaters are still visible. There's no end of works signs or signs to say you can resume 40 after the road works, it just ends.

Are you required to do the 30 or should you do 40? If you're required to do 30 are you then supposed to stay at 30 until the end of the roadworks or until you see a new speed limit sign?

The not relevant limit signs should be obscured.

Hard to give concrete statements but advice would focus on doing the lower limit.

On the basis that some Edinburgh motorists were stopped for "speeding" in a 20 mph "limit", where there were only repeater signs saying 20 mph but the main 20mph signs at entry to the "limit" had not been erected yet. They still got "done" as the police stated that the repeaters were legal signs enforcing the limit. But none of the cases went to court - they were all dismissed (according to inside procurator fiscal knowledge!)

The higher limit is enforceable if both are presented to the driver.

If you mean TRO. There isn't one available to the public from what I can see.

I don't want to speed through the works but with both sets of signs it is unclear what speed you should be doing and so you either go the lower limit (20) and have someone going frothing behind you or you higher limit (40) and risk getting a ticket if the cameras are set up for the lower limit.

Unenforceable, technically - but that obviously doesn't mean there is no speed limit. It should be obvious which ones are current, drivers are deemed to be reasonably sensible, but in temporary situations the rescinded speed limit should be bagged or obliterated. If there are cameras there then the limit to be adhered to will be the sign in the view of the camera, in the case of a rear-facing camera.

Indeed, but AFAIK there must be a TTRO (Temporary Traffic Regulation Order) in place.
If not, then the existing TRO (if any) still applies and the lower temporary limit is not enforceable.
Whatever signs the contractors may erect.

If I asked the cops as well as the fire brigade if they had been notified re temporary roadworks on the A52 Clifton Boulevard
'Nottingham Knight Island' they would reply " er no err yes I mean and if it's to do with a speed camera van they are doing a lot of good ----don't you know' Speed limits are there for a purpose.... Yes I would reply friggin money.

Temporary road works at that island no chance of locating on the local City website and all there is that the camera vans will be on the A52
which is miles long..... yes it has been noticed that no date as per before re sites & date now secret service === Money Money Money.

No bloody road works operatives seen and only off road work being done to verges with no raod works vehicles on the dual carraigeway road..... This must be a scraping of the barrel affair due to most drivers knowing that speed camera was raking it in on the top of the train bridge Clifton Bvd A52 looking for drivers within 50 metres of the 50 MPH limit in the 40 limit.
The new position at the temporary road works is a brand new position with low level 40 signs reducing form 70 MPH...... Money Money Money.

I drove through that bit last week - nothing going on work-wise, but it was Friday, and the great British workman only works a four day week.
Both lanes of the dual carriageway were completely clear of obstructions, but the limits signs had been left in place.

Try the A46 at Newark, approaching from the south - the road work temporary 40 signs have been left there over 5 years since the work finished.

I did contact the council - they passed the buck and said it was Highways England i should contact - next time I have a few hours spare......

It is entirely possible that they are right, and not passing the buck - motorways and most (but not all) trunk routes come under Highways England rather than the local authority
