Freeholders making me pay for my car park space
Discussion
Hi,
A few years ago I purchased my car parking space from the Crown Estate.
I live in a flat and pay ground rent - now the freeholder is charging me ground rent on the car parking space!!
Is this right?
What to freeholders do anyway - apart from arrange buildings insurance - we have a right to manage company for the maintenance work.
It seems the title should be freeloader not freeholder.
please let me know if the Freeholder does lots for the money or is a freeloader as I suspect.
thanks

It sounds like you're leasing it - if you owned it, you'd be the freeholder.
If you are leasing it, there will be ground rent as specified in the lease you signed.
If you own it and are the freeholder, there may still be financial implications for you because unless the space touches the public road, you need to cross the freeholder's land to access it.

I realise they own the land - "get off my land!" - "I do bugger all - but I want your money!"
I bought the space at auction from the crown estate - I though that would mean the crown owned the land and therefore the title would be mine?
I am not sure how to determine the ownership?
You bought a leasehold parking space and the crown estate is the leaseholder. They are entitled to charge you ground rent. This should have been made clear in the auction pack and the legal paperwork will state how many years is left on the lease in the same way that it would on a flat built on the crown estate. Check the paperwork from the sale and speak to the solicitor that helped you buy it.

They purchase freeholds on properties for next to nothing, keep them and sell them for huge sums of money OR they wait until the leasehold expires and start you on an escalating leasehold that doubles/triples every 10 years, to the point where some people are facing £15'000 a year ground rents.Other than that, they live in tax havens (typically small islands), in multi million £ homes and do absolutely nothing all day.
Why is this even legal? Friends in high places.
Thanks fro all the replies
How do I determine what I own - lease or freehold please?
I am definitely lease on my flat - not sure about this space due purchasing off the crown estate - I have paid blindly for years. A missed payment due bank account changes has made me think - what the hell am I paying for - some trust fund spoiled brat most probably!
Thanks

It will say quite clearly in the paperwork that you have from when you "bought" it at auction. How do I determine what I own - lease or freehold please?

Ah yes, every single freeholder does this in all situations all the time. There is no way at all that you’re massively overstating things and relying on hyperbole to make your point. Other than that, they live in tax havens (typically small islands), in multi million £ homes and do absolutely nothing all day.

Like I said speak to the solicitor that did the legal paperwork for you. It is rare that that they sell land. The crown estate is all about income from leases. If your flat is in the same development and is on a lease then it’s almost certain the parking space will be also. Some of the leases are not very long either so you must determine length. Not doing this before purchasing is a serious mistake.

You really should read up on The Crown Estate, who it’s run by and who benefits from its income before going off on a rant. How do I determine what I own - lease or freehold please?
