How did you get a copy of his phone records and vehicle records? That’s something the data protection act covers, so you need to be very mindful about what you’ve got/how you got them.

Helpfully intended, but I'd not be posting this stuff up if I were you and would just delete thread before it goes a bit screwy.

(Also, the Glasgow incident wasn't due to a lapse in concentration)

Fair dos to that then. With a policing hat on its difficult to come up with a concrete answer with regards to retrospectively investigating the accident or any instances of dangerous/careless driving. That would no doubt prove to be a really difficult thing to take on. What you’ve described certainly lends itself more to breaching employers policy (which I assume would contain something within about driving standards and activity.)

With regards to reporting perhaps the HSE or does the council itself not have an arbitration/complaints angle you can persue outside of your management?

FFS!!! You were on the footpath and were hit by a vehicle. That's a banged to rights motor insurance claim, regardless of whether you're an employee or a member of the public.

Get a solicitor on it now and start the process. Off work for 5 months, that's worth thousands.

I don’t understand your approach at all. Why have you activated a dormant membership that hasn’t been used in 9 years to post this? What can you possibly gain from it? Why post all your personal details in the “about me” section?

Unless you were dicking about then the council are on the hook for the injuries you suffered. You should be spending your time taking proper legal advice, although I doubt that your conspiracy theory will turn out to be as true as you’d like it to be.

Legal advice is being taken and the conspiracy theory is all to true but I think your comments have told me this is definitely the wrong place to divulge my story and try to get this guy off the road.

You asked questions about activating a dormant account, personal information and came across as being quite confrontational for no reason so please don't assume the veil of helpfulness now.

I have explained my situation in much more literate terms than most posts on here do and the details were there for you to see. To then insinuate I may have been "dicking about" when this has been a pretty nasty time for me and you have my version of events really is quite inconsiderate and not helpful at all.

So really you responded to a genuine and informative query with quite an agressive nature but did not answer my question about who to report this driver to. You instead, as seems to be all to common on here, go into stalker mode and 'reccy' my account and proudly report back with your findings to boost your Internet ballsack.

If you think that is helpful advice then you are the one who has confirmed that not only is this the wrong place to divulge snippets of information but definitely to ask for advice and I have subsequently deleted the previous posts. It's a shame that a small minority can ruin it for the rest as everyone else's posts were quite helpful but I should know better about forums in general.

I will take my dormant account, personal information and my "dicking about" conpiracy theory elsewhere, many thanks.

Very eloquent, but a little emotional.

I told you what you need to hear. Get legal advice. It’s weird that you’ve got union representation and some legal support from them, but you feel you have to ask in a place that you’ve never been before.

It would appear his belief that the driver was on the phone at the time of the original accident wasn't supported by the records & there were no witnesses or other evidence to say one way or the other.

He has obtained records that he believes will prove the driver was on the phone at other times during that day & wants to use that as evidence against the driver.
For that to fly he will need to prove that the phone was being handheld whilst the vehicle was in motion but in the absence of witnesses or other evidence all the driver needs to say is that the device was in a cradle or other clip & being used hands free.

A complaint to the HSE hasn't gone the way he wanted.

His aim appears to be to get the driver sacked and/or banned & he alleged that that hasn't happened because the managers are big buddies with the driver & it's all being covered up.

My bosses then suspended me and are trying to sack me for exposing them but that is another story.

What I am wanting some advice about is; I have managed to get a copy of the drivers phone records for the day of the accident and whilst it did not show a phone call at the time of the accident (I feel he may have deleted the log or was on social media) it shows him making phone calls both in the morning and afternoon whilst we were at work. I have also managed to get the vehicle tracking log that shows the vehiclearly was switched on and moving at the time of these calls so he has obviously not only broken Driving At Work policies but also the law.

My bosses are harbouring him and refusing to take action despite how dangerous this is and obviously the fairly recent events of the bin wagon accident in Glasgow where people were killed from a momentary lapse of concentration by the driver. What can I do with the information I have gathered and what is the potential outcome for the driver and my employers?
