Blimey. If he was driving at even more than 100mph with a phone, hes a retard. Mind you, we all know that these cameras aren't that reliable, so perhaps its unfair to comment.

Might have given the mobile 'phone network a headache, handling all those hand-offs as he leapt from cell to cell at that speed.

I wonder whether they've accessed the network provider's records to confirm that he was using a cell-phone at the time and to see when nearby cells handed the call off.

Total retard agreed,if that is indeed the case, but i would imagine acuracy of the device is a crucial part of the case given that BMW's are normally limited to 155....





granted that maybe a soft limit, guess we'll just have to see what happens.

Blimey, I was doing 130+mph on the Autobahn last week and that tested the concentration. How anyone could do that and be on the phone is beyond me!

You'd need to get authority to seize those under the Regulation of Investigatory Powers Act, which covers surveillance and the like. The form is about 40 pages long, and a right pain in the rear to fill in.

Given that the bloke doesn't appear to have produced his records to say that he wasn't - I'd guess he was!

I know RIPA well (I recall some heated debates with Prof. Ross Anderson at the time it was being drafted). Acquisition of "communications data" is covered by RIPA Pt1 Ch2. It would be handled either on an 'authorised person' basis or by a notice. The 'authority' to which you refer is implicit in the Act and the 'usual arrangements' are in place (and have been since before Day One); certainly they were/are for certain 'branches' . Activities covered by Pt1 Ch1 require a warrant. It was always Pt3 that exercised me (and led to the debates).

My original comment was somewhat tongue-in-cheek. I would suggest that in a case of speeding (even such a heinous () one as suggested here), it would be unlikely that either route would be followed.

I stand corrected! I have horrible memories of filling in a RIPA application for surveillance of a couple of lads suspected of being heavily involved in lifting motorbikes, while some evil DI breathed down my neck. I didn't understand it then either!

As you say, I think the guys a bit stuffed anyway. Now, if he'd been using a hands free kit it would be fine. "Sorry I'm late darling, back soon!"

I understand that the (supposed) culprit attended at the resumed trial on 1st June when he presented the case that he was at a party previous to the offence and someone (cue Big Bad Boy ) had picked up his keys and driven the car, not him .... Big boy did it and drove away, perhaps??????

Verdict deferred......

Must have been an error on the equipment....


All the BMW's I get stuck behind are only doing 85mph while on the phone, and stuck in lane 3
