Hi guys looking for a bit of help. One of our idiot employees has just been caught drink driving in Austria. They have a strict 1 drink only law and a maximum 0.5 limit he blew 1.1 after 2 drinks he got a £1200 fine.

Will this offence be sent to the DVLA and could he lose his licence?
He was hiring a car so not one of our company cars but he does have one. Should I contact our insurance? will this show on his licence?

Any help would be appreciated

Only for driving within Austria.

Tell them.
If they didn't need to know, it won't be an issue.
If they do need to know, it's better they know now than when it comes out in a claim.

Caught in the country so no request for details will be made.
So in principle whether you notify anyone in the UK is down to you

The test reading is too high for only two drinks.

Reading which was given to you is wrong, the test happened with fresh alcohol in the mouth right after a drink, or it was more than 2 drinks.

So that’s 1.1 against a UK limit of 0.8 (blood not breath)

It won't help with the incident that has already occurred, but if this sort of thing is likely (supplier or customer meetings), howsabout a policy that allows for a taxi on expenses?

I wouldnt suggest supplying employees with breathalysers as that could introduce a liability on the company if breathalyser says "yes" but police say "no", or it could reduce fear of being caught drinking and driving.

Agree with poster above that this is more than 2 *normal* drinks. Some seem to forget 1 unit is 10ml of ethanol when they're driving and insist "1 glass of wine is 1 unit!" as they quaff half a pint of 15% wine.

Was he on business? I think he'd be looking at the sack from a lot of companies.

Depends on company rules (and whether they're rigorously enforced) and the circumstances.

One of our guy got done after a show we'd been at - initially he was going to get fired as he can't do his job without driving but after some representations we ended up providing a driver for him for the length of his ban.
