Road tax conundrum

Bought a used car privately.
Current owner has removed private plate and replaced with standard issue plate.
DVSA advised online, new V5 on way to current owner.
I am unable to tax the car as the current V5 reference number is no longer valid.
Car is still taxed by current owner.
I've paid for the car and plan to collect Saturday.
Can I drive it away legally using the road tax already applied to the car until the new V5 turns up?
Car is insured on my own policy from Saturday.

No, the existing VED is voided from the point at which you become registered keeper even if DVLA have to apply it retrospectively once they are aware of it.
That's the issue, I will have bought the car but not become the registered keeper since the new V5 is not yet in the hands of the current registered keeper. I perhaps haven't explained this very well. The V5 that is en route from the DVSA is for the new registration number but still in the current owners name. Once the current owner has this V5 we will send the docs back to the DVSA for the change of keeper and I'll tax the car.
However when I pick it up on Saturday we probably won't have gone through the V5 exchange since it's still en route from the DVSA.

Indeed. Even though the current owner has transferred the registration number online DVSA don't advise him of the new V5 code other than by sending the new hard copy. As the new owner I'm in limbo until that document arrives.Mr Tidy said:

I think this sums it up - if the car is taxed by anybody it won't show as not taxed on any ANPR device, so you should be OK (even if not quite legal)!Car is still taxed by current owner.

Certainly in the county I live in the plod don't check for tax or mot on ANPR. They'd be stopping too many cars and getting nothing else done. Just insurance they check. Then if you get tugged the rest gets checked.
I got the timing wrong and drove my landy for 6 months all over the country with no mot ( thought it was done on the date I bought it from a dealer ). Drove by plenty of cop cars.

DVLA don't send the new V5C electronically.The flaw, if there is one, in this deal is two-fold.
The first is a vendor so in love with their own reflection that they didn't take their vanity plate off before the sale.
The second is a buyer who bought a car without the V5C present, then looked surprised at not being able to tax it without spending another £25 on a V62.

The vendor should've changed the plate prior to advertising the vehicle for sale. Perhaps the OP should wait until the vendor has the correct V5 before purchasing? If the paperwork is a bit of a mess, who knows what else might be lurking around this transaction?

You explained it fine, and its still the same answer, from the point you are nominated as the registered keeper the car is no longer taxed regardless of when that information reaches, or is actioned by, DVLA.However when I pick it up on Saturday we probably won't have gone through the V5 exchange since it's still en route from the DVSA.
Thanks for the responses folks. Both the vendor and myself were not expecting the change of registration to be an issue however you learn everyday. It does look like the V62 is the way forward, I'm not worried about cost but want to do the right thing and this thread has helped to reach that conclusion.
Car purchase has been a very satisfactory experience and way preferable to using a dealer, car is mint and can't wait to use it.
