Looking for some guidance please regarding what happens after an Rtc..At the end of April I was knocked off my motorcycle resulting in me sustaining serious leg injuries and other life changing injuries. I’m currently writing this from my hospital bed. I was hit from behind by another motorcycle, the rider is also in hospital,with serious injuries. It would appear I was the innocent party.My wife got in touch with Bennett’s insurance who have passed it to a company called 4 dimension. Having never had an accident before I’m not sure what the procedure is. 4th dimension called my wife to ask if we want them to come and asses the bike or do we have someone else in mind.My question is. Are they not the ones who will look at the bike and decide if it’s a write off or not. Do I need a second opinion?. I just need the claim settled so I can pay Honda finance the money I owe them. I apologise for the long thread, I have a lot of drugs inside me. But it’s something that I want sorted and have no idea as to what is going on..

First of all Phil, try not to worry. I know that sounds like a platitude, but your main concern now is yourself.

4th Dimension represents many of the UK's leading motorcycle insurers and brokers, so just leave everything to them.

If your bike is written off depends on many things, an important one is how new it is. If it is very new, you may find that the pay-out does not clear your finance. Did you take out GAP insurance? If you did, then relax, you have nothing at all to worry about.

If you didn't, then (again) it depends how "new" your bike is. I'm assuming as you've referenced Honda Finance that it's fairly new still. The idea of your insurance policy is to leave you in the same position as you were pre-accident. Finance charges can upset this theory sometimes, but interest rates are low these days.

If you really were not to blame, then your insurers will be claiming from the other rider's insurance. Bear this in mind.

For now concentrate on getting better, I know this is a difficult time but it will all sort itself out. Let the insurance people do their job, you've paid for the policy, for just this sort of situation.

From what I can see after a bottle of red, 4 Dimension will sort out the bike side of things.
As already said by KFP, get your Mrs onto Andrew at White Dalton Solicitors for your personal injury side of things. If your injuries are life changing you want to make sure someone is fighting your corner.

Thankyou for your kind replies. Time is something I have a lot of at the moment,everyday is like Groundhog Day and I need to be doing something to keep my mind occupied. I did get confused as 4th dimension asked if I wanted to use someone else,I thought one used who ever the insurance company was. To answer a few questions. Bennett’s sent a solicitor to see me re personal injury. This is all new to me but as I’ll never ride a bike again, my career according to the surgeon has ended and I’m looking at a year before I’m back to 99% normality I’m apparently looking at a large payout. But in all honesty I’d rather have my leg back.. Alucidnation,I highly recommend Ketamine, fentanyl and morphine, trust me you will be off your head before you know it 🤪🤪🤪🤪🤪.
The bike is a 2015 Honda vfr800f. 6k on the clock,had never been used in the wet,bought from a Honda dealer using Honda finance, no Gap insurance taken out. Traff pol have informed my wife that my bike is very badly damaged,I’m hoping it will be written off. The bike was fitted with Honda side panniers (£640) option. I took them off prior to the accident and they are currently in the garage. Do I have to give them back to the insurance company or could I sell them privately? . Thanks again..Phil

Concentrate on your recovery.

The IC and other parties will sort out the bike payout and injuries claim etc..

If you need something to occupy your mind get an Xbox and load Fortnite. It will occupy every waking hour.

Secondly I cannot understand why you are so focused on the insurance payout for the bike when the payout for your injuries is likely to be so much more than that. In my humble opinion you should be concentrating on getting well and getting a top personal injury lawyer on your case. The situation with the bike is the least important part of the jigsaw.

Incidentally, what type of career did you have that after getting back to 99% fitness you will not be able to pursue?

Nothing really to add other than repeating what others have said, concentrate more on your recovery and let the insurers sort out the bike etc, it sounds like you have a long road ahead of you, so sink everything into that, best of luck mate!!

My BiL was in a similar position to the OP 5 weeks ago, albeit car rather than motorcycle related. He has a broken leg, titanium plate holding it all together, broken sternum and other bits. He is also self employed and screwed till the end of the year.
His focus whilst in hospital was getting his car payout sorted, much like the OPs bike. It's by no means the most important thing but gave him something to focus one, to try and take his mind from his injuries and focus his attention on something he could at least try and do.

OP - sorry to hear whats happened. As someone above has already said, get yourself a damned good personal injury and loss of earnings lawyer (not always best from your insurance company) I can highly recommend Les Shimmin from Lansdale & Holdsworth (L.Shimmin@lansdale.uk.com) but whoever you use make sure it's a good one. I would also seriously think about trauma counselling in the near future, my BiL has had several breakdowns etc from what has happened to him and it really is worth thinking about.

After the OP said he'd rather have his leg back I would assume it's one that requires two legs.

I wouldn't stress about the bike, that'll all get taken care of in the fullness of time.

Re personal injury payouts, don't settle for the first offer unless it's amazing. It took me seven years to finally settle the PI component as it can take a long time for life changing injuries to be assessed. You can have interim payments if you're in financial difficulty.

As for your injuries, it took me twenty years to fully heal, where you are now and where you'll end up are two very different places. Good luck on your recovery and don't let it get you too down.

Sorry to hear about your accident, never good when a bike runs into another.

Are you insured with Ageas through Bennetts? They use 4th Dimension who were absolutely awful with my bike last year. They pick up the pieces from the recovery yard and dispose of the bike, giving a valuation. Really difficult to get hold of.

They took almost 4 weeks to collect my bike from the recovery yard when I was knocked off, by which time it had sat outside and rusted up, affecting their valuation which was low compared to where I valued it. As both parties were insured with Ageas they decided it was 50/50 despite the police report saying the other party changed lanes without looking. The Ombudsman will not deal with liability but did finally get Ageas to pay out last month, 11 months after the accident.

Do you have solicitor cover? If not get some serious legal advice, not a no win no fee lot.

Thanks for the reply I appreciate it.. re the insurance. As has been said,it gives me something to focus on as I’m stuck in bed doing very little.When I start thinking about something I have to get it sorted ASAP. Don’t ask me why, because I can’t tell you.. I also want it settled so I’m not paying a monthly figure to Honda for a bike I no longer have, As you say why am I worried, I’ve really no idea...
Re work. I’m a paramedic working on a response car. Sadly the bones in my foot and ankle have been damage beyond repair. Driving will be an issue. Occy health/ driving school are unlikely to pass me fit to drive under emergency conditions with a fused ankle...
And carrying people downstairs is too much of a risk to myself and the patient..

Don’t write yourself off too soon, the body has a phenomenal ability to recover in the long term.

I’ve lost 2” out of one femur, my Mrs didn’t even notice for the first month after I met her.

You’ll adapt, it doesn’t seem like it now but you will.

Whatever you do, do not accept a solicitor chosen by your insurance company. Somebody above has suggested White Dalton and that is an excellent suggestion. They are very professional and experienced and have done a first class job for many of my friends and myself, some in similar situations as yourself.

Forget your bike as it's irrelevant, all you need to do is focus on your recovery and leave White Dalton to do the legal legwork. They will deal with everything.
