Hi

My daughter completed a speed awareness coures last year, 37 in a 30 zone.

She has now been caught on a smart motorway in Derbyshire and has been offerd a Smart Motorway coure, the letter states
" Please note Smart Motorway Courses are offered for offences committed on the Smart Motorway System between junctions 27 to 30 on the M1"

Does this mean she can do this course? I understand you cannot complete a second speed awareness course within 3 years for the same offence but id this a differrent course/offence?

would be great if shee could but don't want her to get into trouble by doing this, anybody done the same?

A speed awareness course is not the same as a smart motorway awareness course. There's a clue in the name, and in the very different things they'll cover.

I understand that they are different courses but was unsure if they are counted as the same in terms of the 3 year rule?

If it is being offered then take it.. I was under the same impression as you.

I took a speed awareness course in 2016 for 81mph on the M4, then I was given a rider awareness course for red light violation a few months ago.

Edit:

"If a person attends a course they cannot attend another course for a similar offence within three years from the date the original offence. "

and, regarding motorway speeding:

"The matter of a course offer rests entirely with the Police force.

Motorway Speed Awareness Courses may be offered to those caught exceeding the posted speed limit in a motorway environment when then the variable electronic signs and signals are operating and active. Any offences outside of this will be dealt with through the other courses. If someone has had a National Speed Awareness Course and they are caught on an active Smart/Managed/Controlled/ Motorway they may or may not be offered a Motorway Sped awareness Course depending on the circumstances."

I guess they found a new course to invent, to be able to cash in on the speed reduction for that section, which is purely due to emissions.

As most would know, its 60mph during morning and afternoons, to reduce pollution caused by lorries....

Yep. Their speed limit is 60mph, but they are required to be fitted with a 56mph limiter.
