I've mentioned it in FD&R but posting here to ask about the legality of advertising food in a restaurant at prices excluding VAT without it being stated on the menu.

Doesn;t sound right to me, advertising something at a set price on a menu then adding 20% to the bill for that item.

Not quite sure but if it doesn’t state “plus vat” then you presume the cat is included. Especially when it’s a consumer to business transaction.

If a menu is an advert (I am not sure on that) then I would refer to this: https://www.asa.org.uk/news/to-include-or-not-to-i...

This (somewhat old and a source I am not 100% sure on) indicates that "VAT must be included in meal prices displayed outside, or in, a restaurant, but they don’t have to be included on the menu": https://www.themix.org.uk/money/money-rights/resta...

I would personally expect the price in the menu to be the price I pay

In which case I'm not sure whether I would want to eat in that establishment... wink
