I had a incident in dec 16 where I visted the taunton deane service twice in a week and was sent a parking fine to a company owned car and I challenged it and got it cancled and apology and £15 in gift vouhcers.

They claimed I was there for 3 days before.

This claim is for 13 hours 39 mins.




Wells its happened again but my company have been billed £90 which has been deducted from my wages!

Anone fought a fraudulent charge after a company has paid it

Well, it’s happened again but my company have been billed £90 which has been deducted from my wages!

Anyone fought a fraudulent charge after a company has paid it?

I have drafted a response.

I have email from there Director Mike Heaton of Loss Prevention dated 14/12/16 where the admitted the error canceled my previous tikcet and sent me a £15 voucher.

Mike,

WITHOUT PREDJUDICE

You may recall nearly two years ago I pointed out a major flaw in your Parking Operators (CP Plus) in late 2016, of the ANPR Parking System at your Taunton Deane Site. I was given an apology and I believed some remedial action would be taken. As this has not been address and it appears more fraudulent charges are being issued nearly two year later.

In this case I now work for a company who are a Highways England Contractor and the vehicle on hire to us **18 *** has visited the site twice in one week one at 18.14 on the 05/09/18 and then again in the morning @ 7.53am on 06/09/18, as I did this morning to purchase a Costa Coffee from your site (proof of this is shown on my costa statement as I didn’t get a receipt).

This has happened again but the car is owned by Days Fleet and so they have paid the £60 and not allowed us to challenge the ticket. However our tracking data shows the car was stop for 12 minutes not the claimed 13 hours and 39 minutes as these are two visits and that is pretty clear as the system has failed again. I am working on the same motorway network you serve and it’s cost me money this time as the £60 fine was paid plus a £30 admin charge, proof of which is attached.

I have attached a copy of the fine I would request a cheque for £90 is made to payable myself or I will take legal action as this maybe system error due to the notorious unreliable ANPR system employed by your contractor but as you are aware about it and they operating on your site if this made it court as this happened again and you admitted in writing to knowing of this flaw on the 14/12/16 (attached) unless you are able to prove you have taken reasonable steps to eliminate customer being falsely accused of overstaying the free period in carpark when they are just visiting twice in the same week it could be viewed you are complicit in this unlawful action and then jointly liable.

This could be viewed as Fraud as CP Plus are aware that sometimes multiple visits can result in Charges being issued and falsely claiming overstay and breach of your terms which clearly isn’t the case here yet again.

OP, firstly, I don't think you need the without prejudice. Secondly, I think you should write "nicely" first and ask for the money and then escalate to a more demanding letter, before a final letter before action type of letter if needed.

Also I think you should get someone to proof read the letter to remove the typos etc.

IANAL but would go for a less confrontational tone - let's give them the benefit of doubt and assume that it is a genuine (automated) mistake that they'll be happy to resolve once brought to their attention.

• This vehicle has been mistakenly issued with a £60 fine for overstaying the free parking limit at the Taunton Deane Site.
• The vehicle YB18 *** visited the site twice in relatively short succession: First at 18.14 on the 05/09/18, departing after 12 minutes, secondly the following morning at 07.53 on 06/09/18, departing after XX minutes.
• On both occasions the duration of stay was within the free parking limit.
• The monitoring system in place appears to have taken the entry time from first visit and exit time from second visit to calculate a single, longer stay.
• The vehicle is fitted with a tracking system and whereabouts in-between the two visits can be proven.
• As vehicle YB18 *** is owned by Days Fleet, they have paid the £60 invoice, and charged me an additional £30 administration fee without giving me the opportunity to challenge. (see attached)

As this is a known error in the monitoring system in place at this service station (see previous correspondence from 12/12/16), I request that you reimburse me for the £90 as soon as practical.

Surely the company should have informed you before making the deduction? Is it legal otherwise?

Partly why I am so cross, we got invoiced on the 17/10 and first thins I knew was a deduction in this months wages. They normaly notifty you but they failed on this occasion.

They are now trying to appeal it however I told days them they won't entertain that after payment.

No ANPR should be for goverment use only not lazy criminals under the banner of parking enforcement and the industry should be properly regulated.

I sent a really nasty response last time saying they had breach data protection lets hope the softly softly gets it done as I am £90 down the pay before xmas not much fun.

Techniclally they weren't entitled to the keeper data in this case as no breach of terms was made! So it could be argued they have breached data protection.

I could do but under two years service whats that going to do create trouble? Left my last company for rocking the boat on things, when I should of kept my head down, had some good friends and a short commute 2.5 years was happy there. Kicked up that the MD had done some daft stuff without involving me and thought two directors had my back but it wasn't enough.

Now I have a stty highways depot in the middle of nowhere 40 minutes or Bristol office that takes an hour and 15 minutes. An a punishing month end schedule.

Got an apology and a good boss and a decent pay rise what else do I want!

I’m pretty sure your company can’t deduct money from your wages without signed authority from you.
