hi

New to all of this

i currently have 9 points on my license all recieved in the last 3 years

79mph in a 70
79mph in a 70
77mph in a 60

drive a company vehicle and have just been informed i have been caught speeding again 36mph in a 30.


ive never previously been offered a speed awareness course and was wondering if anyone has been in a similair position and were offered the course

I suspect you've got a 6 month totting up ban coming your way, unless you have a very good case as to why you not having a licence will cause unfair hardship to OTHER people, not yourself.

Get some good representation, do it now. AGT Law on here would be a good place to start.

Id recommend learning what a speed limit means

If you've not been on a SAC in the last 3 years, then AFAIK, your chances of being offered one for this latest offence are not effected by your existing 9 points. You might be offered one, you might not. Of course, if not, then it's almost certainly a 6 month totting up ban.

I'm not judging, just looking at the facts presented. You've been caught 4 times!

Anyway that aside - you might find they come down harder on you this time as you were in a 30 zone, more likely to be a built up area with pedestrians etc. Plus this time of year is notorious for 'speeding campaigns' - I live in Sussex and there is a big push on it at the moment: extra mobile cameras, patrols and so on.

If you've not done one before, you should get offered it. It depends what policy the force has. Down here you would if you haven't done one before.

Unless its in Scotland, and don't believe they do them.

Yeah one was in first one in dumfries then the second was in North Yorkshire, first one I got pulled by car second was a van

You've shown you don't listen to advice, though. Everyone on here speeds from time to time, but you need also to pay attention. Getting caught that often is just slack!

It's a fair comment though isn't it, you have been habitually driving around at an indicated speed 10-15mph over the speed limit and this is the fourth strike, seems like you need to work on your observation.

If I was driving a lot of miles for work and had 9 points then I'd probably spend a few years pootling about carefully watching my speed.
Luckily, I have never had any points for speeding despite driving quite fast when appropriate.

It does irk me that the totting up ban for very minor offences is so harsh and takes no regard of the seriousness of each of the previous points related incidents. Is it more of a danger for someone who does 120mph and gets a couple of months ban, or someone who gets done for 48mph in a 40mph limit four times and ends up banned for 6 months??? Not to mention the pot luck prize of convincing the courts of hardship, and the stories of people driving round with 20+ points.

I'd be surprised if you dont get offered a SAC for the 35 in a 30. AFAIK - they dont take into consideration previous convictions.

I understand the 36 in a 30mph, but I am surprised you pulled over and done for 79 in a 70?

You will most probably be offered one for the 36 in a 30. Not in Scotland you won't though, they don't have them.

If you reply too late then you won't get offered one.

The number of points you have makes no difference at all.

Thank you for your question and welcome to Just Answer. I will try to help with this. Please RATE my answer OK SERVICE or above.

There is no reason in law that you cannot be offered the course.

However, many constabularies have a policy of not offering the speed awareness course for a person with 9 live points on their licence on the basis that to do so would subvert the will of Parliament which was that a person who acquires 12 points will be liable to totting. They may or may not take that view.

This is a speed proportionate to the level that renders you eligible for the speed awareness course.

If you have not completed a course in the last 3 years then you would otherwise be eligible.

I'm sorry this isn't the answer you wanted but it is the position that you face and I have a duty to inform you truthfully.
