Evening chaps.

Do we have any employment solicitors on here? Pretty sure we did but not sure who.

My wife has an ongoing issue with her employers, been off work for 10 months due to the work environment (bullying and lack of action from management following occupational health referrals to AXA), now on no pay and still awaiting result of a grievance which has been repeatededly delayed by the employer. She has been told she has a case with a no win no fee solicitor for constructive dismissal but wondered if its worth running past anyone else beforehand.

Sometimes I just don’t get this place. Your wife can access insured legal advice from a qualified person who owes a duty of care to her, who will have knowledge of all the relevant facts, and yet you’re asking a bunch well meaning, but largely unqualified, of strangers what might happen on the basis of a completely inadequate set of facts.

Sorry if that seems harsh, but go see the solicitor.

surely acas is first point of call for free advice. i wouldn't use no win no fee.

This.
But don’t rely on ACAS...the service is variable at best but you will be expected to have exhausted this avenue.
Problem is, that if you start paying solicitor’s fees you will quickly eat into any award and costs are unlikely to be recoverable.
CAB might help, but again, can be variable.
How many years service does your wife have?

Sounds distressing, but not unusual these days. The main issue is that to be constructively dismissed, she will have had to resign and that's a big commitment to make without real legal advice. The problem with 'no win, no fee' is that it's more appropriately known as 'win, fee'. Could she make more efforts to speak to the employer without resorting to leaving?

Check if you have any legal expenses insurance, for example on your home contents policy. A lot of people have this cover but either forget or simply don't know they have it.

If you do have such cover and your wife has a good case they will pay for specialist solicitors to fight the case.

Not covered for any grievance procedures sadly on home insurance.

You won't be covered unless and until a claim is lodged - even the drafting of the claim form etc will be precluded I suspect. They may also try to claim that you are required you use their panel firm, that is incorrect.
