Hi

Have received a parking fine for being parked in this bay.

Fine states "Stopped where prohibited (on a red route or clearway)"

Fairly confident they wouldn't send the fine out if they weren't correct but seems a little incorrect? Thought it was a bonafide safe place to park, only one space left when I got there.

Any thoughts?

It's a bit of hard-standing not a marked parking area. Might as well be a bit of a grass unless there are signs indicating otherwise but then you wouldn't have got a PCN.

Not that it helps you, but if they're ticketing vehicles parked there they must be making serious money, as until recently I drove round that roundabout regularly and there were always cars parked there.

It will be a private company masquerading in a pseudo official capacity claiming that you have breached byelaws.

A private parking company cannot enforce byelaws in the way they are trying (i.e. paying a private company in lieu of the airport authority not prosectuing for a byelaw offence in magistrates)

Also Airport land is not relevant land for the purposes of private parking under POFA as it falls under the RTA and private companies cannot operate in this capacity either.

I have done this quickly on my phone and probably not the most clear explanation but in essence dont pay it but play letter ping pong with the parking company until a point at which its 6 months after the alleged "breach" and then you are off the hook in terms of byelaw and they cant then revert to private parking ticket.

Edit: Looking at the photo it does appear you may be outside of the clearway but on double yellows/reds.

There is a drop curb and area clearly designed for vehicle. Plus I can't see any signs saying No Parking, Private, Keep Off, Authorised Vehicles only.

I'm not saying it is legit to park there, but there is nothing obvious to say you can't and visually/observationally it seems to be designed for pulling off of the highway and parking on.

the highway is the whole area from boundary to boundary including the pavement and verge

Double yellow lines would prohibit parking, but I think Airport Way is now a Red route which would mean no parking along its length except in a designated bay

Also, it's not a red route, the lines are yellow. And those yellow lines are broken and deteriorated. Does the latter fact open tickets to challenge?

Not since 2007 when the TSRGD were updated and any requirement to have a continuous and solid yellow line were removed. Same applies for T bar end markers on yellow lines.,


As above though - it's not a designated parking bay. But we have had a fair few fines for that very spot too - it must be a common place to stop, and I doubt there is much incentive for the council to make it less attractive to park if they are collecting revenue from it.

You're not on the road, but how on earth could you think that was a legitimate parking space?

You took a punt and it didn't pay off, pay the fine and move on

Because it had a dropped kerb, is paved and shaped for parking and had others cars parked on it nicely spaced.
Other places I have seen these state "emergency vehicles only" etc.. but this seemed fine.

It also helped that I had a Job interview at Vauxhalls in <5mins.....

Paid.

That's fine, but with a drop curb onto a parking area, how would you know it wasn't a parking bay? It simply doesn't say.

I've looked at it on Streetview again - I think the dropped kerb is a pedestrian crossing point.

Also to note that the CCTV camera that recorded the clip linked above wasn't present when the lines were yellow. I wonder why they spent all of that money on a camera system, rather than filling in that gap, or at least making the area less "parking space like"...?.

Probably a nice little earner from taxis and relatives waiting to go up to collect at the airport!

AIUI red routes have to have marked bays to allow parking, it would be different if that area was private property but as it’s part of the highway that makes it part of the area you can’t stop in.

Maybe, but it does seem a little bit like a kind of entrapment with an area clearly designed for a vehicle and drop curb to it. I'm not suggesting the op tries to battle it, but suspect it is a little cheeky and not strictly legit how it is.
