Student housing rental question.

"Interesting" I've just read off someone I know.
"Student renting a house in xxxxx whilst at uni.
They are home for the summer.
The tennancy on the house in xxxxx does not terminate until Mid Aug. ( they still paying rent until then )
The landlord in xxxxxx has new tennants in the house !!!
Is the landlord allowed to do this ?"
Most are of the opinion it's not allowable, as I am.
If said student still had key (which I doubt) I'd be telling them to 'move back in' for a bit for a giggle.
It would be interesting to see what the "check out survey" says if the incomers cause any damage prior to mid August.
I'd assume (probably wrongly) landlords can't have a tandem tenancy running with completely separate parties taking money off one whilst renting to another? (Saying that the Gov take double bubble every month on car excise duty every month on bought/sold vehicles).

They haven't surrendered their tenancy in that they have paid until end of August.I assume they can ask for a refund for the 2 months extra rent paid that the landlord has relet it out whilst still technically rented out to them.

Landlord is being a bit sneaky (he probably knows full well that most students will vacate after their June exams have finished and plans to get "double bubble" as you put it).
The only option would be for the student to ask the LL for a partial refund or alternatively say he's moving back in.
Having said all that, when my kids are at Uni the contract is usually from September to June, purely because they move back home for the summer (or to wherever they get an internship, if they're lucky).
Why not email the landlord informing him that they have secured a job locally and intend to occupy the flat until the end of August and express relief that they have got somewhere to stay with the rent paid up front as the job isn't that well paid.
If they don't have a key innocently ask where they can pick one up. Give dates of intended use so the landlord knows just what's happening.
