LTI 2020 'TIMEOUT' message

I received an NIP for doing 39mph in a 30mph limit over Northam Bridge A3024, Southampton in Nov'04 on my motorbike, in dry clear conditions. I rarely go down the road and it really does look like at least a 40mph stretch, being a wide open dual carriageway on the bridge itself. I had left a 30mph side road at Quayside Road and then turned off at the lights the Southampton end of the bridge, so only used the bridge section only for a short distance. I don't remember seeing it but there was apparently a mobile van parked somewhere on the central reservation at the 'Bitterne bend', near the Quayside Road turning I came out of. I was caught doing 39mph on a LTI 2020 (going away from the camera).
I have read the interesting LTI 2020 info on: www.pepipoo.com/Case_Files/documents/CF11_LTi2020_screen.htm that states if the picture they send you as proof shows the word 'Timeout' in it that is not sufficient evidence as it does not guarantee it was measuring YOUR speed - it may be someone elses or an inaccurate pan round. I have asked the ticket office to send me earlier still frames without the 'Timeout' word in the picture, as this is required to allow any prosecution.
All this has come to my attention after receiving a 6 months ban on 24 May'05, as a result of this. It (just) brought my points to 12 with 3 years. I am appealing against the decision as I am a courier driver so am now really stuck, and I have 3 children to look after. It looks bleak and seems a harsh decision.

it definately shouldn't say 'timeout' in the picture.
The LTI 2020 measures the speed, then displays it for a few frames, then says 'TIMEOUT' until the trigger is pressed again.
If this is all they have, then there is no evidence.
The set up they have shouldn't actually print an image with 'TIMEOUT' displayed.
In court however, they will very likely use the original video recording which will have the speed without 'timeout' as can be proven using the pause button. Unless you're innocent of course.
That video however may not exist now.

My appeal was issued on the exceptional hardship this will and is causing my family as a result of losing my licence. Then I discovered this info about the LTI-2020 evidence being arguable in some cases, and after talking to my lawyer, it is possible to argue this as well as the hardship evidence...

Ask them to either let you view the video and see the measurement or for a copy of your section of the video.
The timeout will appear after every measurement the system makes so contrary to popular belief, the message is entirely normal, even essential to ensure the correct vehicle keeper is issued with a ticket for the measurement.
Your video will still be in safe keeping for an offence committed in November 04.
