Breath test procedure
Discussion
Watching Road Wars etc there are references to a breath test being delayed if the suspect has drunk alcohol within the last 20 minutes. In one case the suspect had been seen drinking so everyone had to sit around for 20 minutes before the breathalyser check, which turned out to be a pass.
In that situation could they have done one test straight away, and if negative treat it as a pass and only if positive hang around to see if another test 20 minutes later was still positive? Or could the breath reading increase over that period?

Bloke on a moped by any chance?
You don't have to wait the 20 minutes, however the manufactures instructions say to wait 20 minutes so no mouth alcohol can effect the device.
If they don't want to wait the 20 minutes id explain why im waiting and let them decide.
If it's the one I think it is, one says by law they have to wait 20 minutes which is wrong.

Think a driver is only obliged to provide one roadside specimenIn that situation could they have done one test straight away, and if negative treat it as a pass and only if positive hang around to see if another test 20 minutes later was still positive? Years ago during our training to use the breathalyser we were each given a very small amount of alcohol.
Breathalysed in the classroom immediately afterwards and all failed...mouth alcohol.
20 mins later breathalysed again the small amount of alcohol didnt register.
The breathalsyer requires a "good" amount of breath in one continuous blow
