Large broadband/Mobile provider - take them to court?

A company that only has 2 letters in there name (Might be the same letters) have been taking £40 out of my account for the past 6 months and refusing to pay the money back. We moved house in July and swappped to BT as they couldn't provide the same service. They account was never canclled pn their end.
Should I take them to court or is there an easier way to get this money back.

I had a similar thing 10 or so years ago with another two letter provider who may or may not have been endorsed by Bob Hoskins imploring "it's good to tawk".
They kept taking money after I left them until they decided one day to send a letter threatening legal action over my unpaid debts to them of c£500. It took me threatening legal action with them before they realised their 'mistake' that they actually owed ME £200. Didn't even get an apology just a cheque through the post.
Do you have any more information about the situation, when you initiated the cancellation, were you outside of the contractual period etc? You can always call them up and threaten legal action and request a subject access request to obtain proof of your cancellation etc. That might provoke them into some positive action without actually going through the cost of submitting an actual legal claim.

Do you have any paperwork or emails as proof that they were willing to let you out of contract early? IANAL, but suspect unless you have this you won't win a legal That's about all I know to be honest.

I had a similar thing with business mobiles
took out 2 phones, same deal, but they where charging one a £40 a month and one at £90, this was not spotted for some time.
Checked the contract, both phones at £40 , called them up and told its tough, should have checked the DD, and that the phone on £90 had included a lot more minutes even though they weren't used they could have been.
I threatened small claims, and was told on the phone that was fine, they would insist the hearing was in the North of England and they employ a legal team that deal with stuff like this all the time so do what you like .
I Just gave up and will never use that company again, i had a contract so was in a good position, you only have a verbal He said/she said, take the money and let the stress go would be my advise

DD is easy to cancel online/app.
Mind you, they would still probably come after you for the money but would probably be easier to deal with.
Keeping it is easier than trying to get it back.

·Did they tell you on a call? If so submit a subject access request and insist on the transcript of the call where they mentioned this. Hopefully it'll clearly show you were told it would automatically be closed though I suspect they will try and insist you had to inform them formally with xx days notice.That's about all I know to be honest.

They claim I made £300+ of calls, on my line, that I hadn't and then they claimed someone must have tapped my line to use it.
Wouldn't refund anything, and I ended up leaving them for broadband, land line, and mobile. When it came to renewals, they also lost the best part of 400 work mobiles as I was responsible for negotiation, and asked for their best price, which was easily beaten by one of the other big mobile companies, and I never gave them the opportunity to counter bid.

Given EE and BT use the same infrastructure, what service couldn't EE provide ?
Whenever I move the take on supplier has informed the company I was leaving, that way I could keep my landline number.
Did you get to keep your landline number or did you move out of the area ?
I would hope this is easily fixed as they are the same company. You may have some hoops to jump through if you didn't terminate the EE contract or if it couldn't be terminated.
