I agree that there should be a punishment but imo 3 points is harsh. In comparison with other offences that attract three points, this isn't dangerous at all.

Same as exceeding the speed limit when it is posted for noise reduction purposes, it's anti-social rather than dangerous driving.

About time they gave some flexibility by introducing penalties of 1 or 2 points for less serious infractions.

(btw I am very anti lane hogging)

I'm all for it. And if 3 points and £100 fine is what its going to take to make the message clear then that absolutely gets my backing 100%

The tricky bit will be the fact its open to interpretation I guess - how long a stretch without a pass is acceptable without being hit with the points / fine?

I did chuckle at the quote in the article about the M8 being one of the most common places for undertaking mind you - if folk were in the lanes they were meant to be in tthen perhaps that woudlnt be such an issue.

This needs to be a national campaign that is high profile and shows that action is being taken...

Use unmarked cars, get drivers stopped and action taken against poor standards of driving...

It's not just about sticking up cameras to capture speed, most of the poor driving that we see that causes problems to other motorists occurs below the speed limits and never gets penalized...

Speeding isn’t dangerous either in most cases, it’s just against the law as is blocking the overtaking lanes.

It should attract the same penalty as regular 3 point speeding.

Hope the middle lane Morons will take note.

Good. Perhaps a tough punishment might help them remember to keep left although I thought that "lane hogging" carries this penalty now anyway? If they had a patrol along the M56 in the evening rush hour, they'd make a killing.. As far as danger goes, it's not necessarily dangerous in itself but it often causes other drivers to be dangerous. Undertaking, causing jams, road rage etc.

Would it? It would be chaos as everyone pulls onto a motorway, picks their favourite lane and then just sits there forever. At least most people currently move over once they’ve overtaken. With your plan nobody would ever move apart from those wanting to get a shift on and we’d be swerving lane to lane to try to pick a way through.

At some point there would be a rolling road block caused by several drivers driving side by side at their chosen speed, probably 50mph and that would be that with traffic jams being caused not far back with all the braking getting gradually longer down the road.

Good.

Make it an easy to ticket offence with an FPN to reduce police workload so then they will use it more.

Undertaking isn't illegal wink

If the traffic in the lanes to the right is moving slower and you have been sat in the left hand lane it is permissible to undertake. Obviously if you come barreling up the outside lane and swerve to the inside and undertake at speed then you are in the st and will get prosecuted for dangerous driving.

Works well in the US and makes for a more relaxing drive, not having to look out for idiots 'filling the gap' from both sides.

It's not universal across all States. Where it is the roads were designed for it. Their accident levels are much worse, by any measure and it is still illegal not to keep right, unless overtaking.

Good on them. They need to have a blitz on this and the message will gradually be rammed home. Had a classic this morning - some halfwit in a Mini dawdling in the outside lane with nothing in the middle for about a mile. Refused to move over.

I’d also support an instant 9 points for tailgating....

It's quite ironic the way this goes back and forth. There is no law against undertaking in the same way as there is no law against staying in an offside lane when not undertaking or tailgating. We do have without due care or consideration which does cover them.

From CPS charging standards..
There are decided cases that provide some guidance as to the driving that courts will regard as careless or inconsiderate and the following examples are typical of what we are likely to regard as careless driving:
First 2 entries
overtaking on the inside;
driving inappropriately close to another vehicle
...
Inconsiderate...
unnecessarily remaining in an overtaking lane;

As for your situation, we also have guidance in the Highway code to assist with interpretation. It's not true to say its just about the offside travelling slower. There are more stringent conditions than that.

The guidance is in the highway code and is quite simple, for non motorway undertaking there are two obligations under rule 163 you undertake when car is indicating right or if traffic on the right is moving slower than you are. For motor way driving rule 268 comes into play which simply states you should not overtake or move lanes to overtake on the left unless congestion means the left side lane is moving faster than a slow moving right side lane in which case you are OK to keep up with traffic in front of you.

Ultimately for motorway traffic if you are sat in the inside lane doing 70 and the outside lanes get congested and slow down, you do not have to slow down accordingly and are OK to continue keeping pace.

How many times do you see a middle lane hogger and traffic comes up behind him/her then wait until the outside lane is safe to move into, pull out and pass said hogger causing traffic in the outside lane to bunch up as it becomes more crowded?
Until the vast majority understand that passing on the nearside is not an offence, then this situation will continue. By itself, passing on the left is permitted - slower moving traffic on the right - but barrelling down the outside lane then weaving across to the inside and 'undertaking' may be classed as dangerous or careless depending on the circumstances.
