In the current "where there's blame, there's a claim" climate, I'm amazed I've never heard of anyone sueing the police/Cash Grabbing Partnership for mental anguish, when they've been waiting/worrying for the dreaded NOIP to drop through the letterbox. God knows I've been bricking it a few times.

Anyone ever heard of anyone sueing in these circumstances?

So you want to sue somebody for anguish brought about by something which may or may not come through the post? So even if they have done nothing you still want to sue them?

If anybody succeeds with this then anybody who has been charged with anything might as well have a go

Why not - if you are innocent and have been harrased by the plod for no good reason.

I'm expecting an out of court settlement any day now

you cant sue in equity for something thats linked to an illegal act anyway (those who come to equity must coem with clean hands ect..), so the courts would have nothing to do with your claim

So I dont think it would work (however appealing it may sound)

Ahh, but what if the NIP was proven to be invalid, e.g. like the woman a while back that had a NIP for some impossible speed?

I don't see why you couldn't sue for the stress and inconvenience of being falsely nipped, especially if you have proved your car was cloned or something and the prosecutions kept coming.

I guess if the NIP is invalid/incorrectly issued then you have a base from which to make a claim, as your action will not be tainted (from the courts point of view), by an illegal act.

But if it was correctly issued, but still caused you "stress/harm/psyco damage" ect, youve no chance of claiming, (unless you can somehow make your claim by not "exactly" relying on your illegal behaviour, or as was the instance in the seminal case in this area <Tinsley v Milligan> )

Does "some people" include those who make ordinary people (motorists) lives stressful by hiding cameras in bushes to make money?

Not picking but there's always the choice of not speeding. So any stress will be self inflicted won't it?

I just find it distasteful that people with no self respect will constantly try to obtain compensation for the most pathetic reasons. Not discrediting the legitimate claims but the spurious ones drag everyone with a legitimate claim down with them.

Eh! Did you read the thread? It's nothing to do with respect for the law or monarchy it's about people who feel the need to claim for things that are only their own fault. Since when has the wait for a nip to arrive been the fault of anybodies apart from the person who was allegedly speeding etc. So to even attempt to claim compensation is another nail in the coffin that incessantly drags this country further down. For your information though I abide by the law in so much as anybody else does, the only difference is if I'm in the wrong for example I was speeding and then get caught then I am man enough to take my punishment and not try and squirm my way out of it. The law is there for everybody and not just when it suits you personally.

Wolf1 as the quotes are off at the mo I will just repy. My response to your remark was quite clear. The stress of waiting for NIPs from the scum and slime that peddle their speed kills trade at the behest of filth like Blair (elected? 2 thirds said no we don't want you), are supported by no-one. My position on the issue is this. Since 1963 all the laws that have been introduced are crap. The reason for this is that instead of addressing the issues the criminals present, the laws introduced simply victimise the majority. Prior to 1963 we had everything except the internet and child porn covered. Instead of moving civilisation forward by focussing on technology to advance society the governmental filth and royal parasites chose to further line their pockets with legislation to criminalise the majority. In the longer term bad law will not be tollerated for ever. The murders committed by the safety camera slime (elected by no-one) will have to be accounted for in the end, just as those commited by Livingstone and his silly hump madness will too. The fact that you have a problem with bad law and bad application being contested does frankly annoy me as does all forms of forelock touching.

Driving is often done subconsciously. One of the worst anguish I feel is when I drive past the specs on the A610 going home to Notts after work.

Occasionally I get past this bit and don't remember the drive, checking my speed etc. Clearly I have been driving within the limit as no NIP arives but I still feel anguish just in case I forgot to check the speedo.

The reptile brain does a superb job, mind!

Ah! You would be one of these people who think the law doesn't apply to them then! Don't tell me Middle class, detached house, two cars, and a reasonably well paid job (this isn't meant to be insulting but it's probably not far off the mark)
If my having RESPECT for the laws of the country I live in annoys you then maybe you might want to find one that doesn't irritate you so much. The laws regarding speeding have been around longer than the "speed kills" propaganda so why is it so hard to understand that if you speed and get caught they may wish to punish you in the way of fines and points etc, now I'm sure the punishment was implicated initially as a deterrent but yes it does generate cash for the government. However at the end of the day unless you or I actually become politicians then it's nothing but hot air.
I know that if I exceed a specified speed limit I am chancing that I will be caught and could have to pay for it. You seem to feel that you should be allowed to do as you wish without consequence.
Now don't get me wrong but apart from cases where vehicles have been cloned or the measuring equipment was faulty, drivers are all aware that breaking the law (irrespective of whether you like it or not) can result in a slapped wrist so to speak. It's a bit like praying the missus won't find out about the latest bloke gadget you've just purchased. You know it's a fair cop when she finds out, but half the fun is in trying to explain it away. Once she is absolutely positive, you know there’s no getting out of it and accept the punishment (usually cessation of chocolate ration and an evening of cold shoulder at the least). Yes we all like to have a moan when caught out but at the end of the day the worst clique is always correct, “If you can’t do the time, don’t do the crime”
