Have a listen to the audio feed from SCOTUS. At issue: can Trump have his tax records subpoenaed? Justice Thomas, who rarely asks questions, has asked a question adverse to Trump. Justice Gorsuch also appears adverse. RBG still on the ball. Fascinating to hear how the processes compare to those of SCUK/PC.

I thought that this might interest law wonks in S,P&L, but having come here it might perhaps give non law wonks an insight into how cases are argued at the highest level of court. The similarities with the UKSC are greater than the differences, but UKSC does not apply such strict time limits, and the US counsel are more light footed in citation of case law, mainly because of the time limits. US Counsel also say "I think" whereas UK counsel learn at their granny's knee to say "I submit", because the Court is not interested in what you think, only in what you argue.

EDIT: now punted back to SPL.

Clinton appointee Justice Breyer might now be the swing vote, on the assumption that Gorsuch votes with the other Libs, and Roberts, Thomas, Alito, and Kavanaugh vote for Trump. Breyer is troubled by the broad principle that the case could establish.

I just glimpsed Kayleigh what's her face on Fox News on YouTube going on about how the FBI set their sights on Flynn. I clicked away deciding I could watch that another time.

Gorsuch was a Trump appointee, no?

God, I hope he votes against him. That will hopefully give him a heart attack.

Gorsuch is not a terrible Judge. Kavanaugh is a hack and very likely an unprosecuted sex offender.

Trump's arguments did not seem to do as well in the second of the paired cases, which involves NY State. RBG was big on the Nixon Watergate decision and on the Tenth Amendment. Breyer seemed less troubled by the subpoena.
