Can I be prosecuted for speeding by this?

Hi All,

To put a long story short, I have been driving very steady since receiving a previous NIP for 36 in a 30.

However had a lapse yesterday and was doing I believe around 34 in a 30. I know i'm an idiot and should've paid more attention!
Was literally round the corner from my house.

But there were two police officers with notepads, they had a speed indicator device (a temporary one) next to them showing the speed - the one with faces etc.
As I drove past at I believe 34 mph, I saw them noting something on their notepad, which was most likely my reg.

The question is can these speed indicator devices be used to issue a NIP, baring in mind they were both police officers and not community volunteers?

Really upset with myself, do around 40,000 miles a year and two incidents in a short period of time with nothing previously.

Thanks for the response. I thought so, but wasn't sure given the 2 officers could contest that they were eyewitnesses?

When those have been deployed in my area in the past they usually result in a generic letter sent out basically saying watch your speed but no formal action is taken.

Two officers without a measurement device, or one officer with a measurement device (which doesn't have to be calibrated where margins aren't small) is sufficient.

34mph unlikely anything will happen though.

Guess I'll just have to wait and see what comes through the post (if anything). Worry is just compounded by other recent NIP (which I don't have a response back for yet - but hoping an online course is offered).

You won't get a NIP for 34 in a 30.
If you do, please redact information and post up a scan - as you'll be the only person who both claimed and was able to prove a NIP for that speed.

I'm hoping that if anything its just a warning. But time will tell, don't want to dwell on it too much now as it has me stressed enough as it is.
When I say 34, that's what the sign showed as I saw them.

I know someone who was done for 34 though by a policeman with a gun, got offered the course.

Sadly you can get an NIP for 34 in a 30....my Mum was caught with a handheld device about 12 years ago - she was fuming but we all laughed as it was her first speeding offence & she was on the way back from an eye test

The Police often accompany our Community Speed Watch sessions to reinforce the message to keep to speed limits.....if you were doing under 35mph you won’t even get a letter.

Keep seeing stuff like this posted. 2 people at a SPA course I attended in Feb were there for 34 in a 30.

Like I cared. I was there and shouldn't have been, 84 in a 60 ( 70, but I was in the van ). Mistakes have to work in your favour occasionally.

No, you can theoretically and no you don't. I'm sorry - but I don't believe your story.
Everyone knows of "someone" who has been sent a NIP for less than the 10%+2, yet nobody is able to prove it.

Your mum may have got 35, but no....she didn't get done for 34.

I bet they didn't have any proof though, right? I mean, why would they - at a course.
No, they didn't get a NIP for 34. Like everyone else who tells the story - for some reason we are all supposed to have sympathy for these people.
"Ah man, NIP for 34? That is so harsh - peace and love man".

No, they were going faster than 34mph, simple as that.

Entirely possible to be done for 34 in a 30 it its a roadside stop. The 10% plus 2mph threshold does not apply to roadside stops.
