Did the 'Traffic Cops' on BBC miss a trick last night? Some guy was pulled over for erratic driving, blew into the bag and as suspected - was twice over the limit. Got him back to the nick and, after a DVLA check, discovered he was on a provisional so he got done for that as well.
When he got pulled, his travel companions were also p*ssed-up and quite abusive to the BiB's so one of them got done for assault or something - kicked one of the BiB's in the gob - not a nice lady.
Now, considering the driver was on a provisional - could one of the other occupants, who had a full licence, be done for driving under the influence as well since they were (maybe unknowingly) supervising an unqualified driver? Would have been a result to stick another one on the passenger who kicked the BiB.
Pending the yes/no answer..... Not wanting to drive after a few beers, if I got a mini-cab from town and the driver turned out to be p*ssed up - could I get done?

Well if they didnt know he was on a provisional then they really wouldnt be supervising.

Very true - would I need to check every cab drivers licence so he wasn't on a provisional in case I got done for supervising him? Not feasible in the slightest.
In theory though.....?

Doubt no one would own up to "supervising" because they could then get done for aiding a abetting opl/unfit through drink/drugs (Crampton v Fish 1969)

If passenger also ying tong tiddle-i-pooh then is not supervising so driver gets done and yet more aid/abet to be considered.
