6 month ban now 9 months due to DVLA delays help.

Further to my previous thread regarding the process of getting my bosses licence back after a totting up ban, I have another question.

Ban is complete today, and while the paperwork was all sent back, there is a 3 month delay at DVLA to process it.

Of course that means no driving, but has anyone heard of any dispensation due to them stopping the processing of these licences back in March? The lady at DVLA said they stopped processing them (for drivers after a ban) back in March, and only just re-started, hence the 3 month delay.

This will mean that a 6 month ban becomes 9 months (potentially, based on her estimates).

What did the lady at DVLA say about a dispensation ?

They are the only people with the answer.

She said she wasn't aware of aware of any, and to just wait.

But she also said there might be something that she didn't know about.

It is not the end of the world, but the boss would like to get back driving ASAP-I think clutching at straws is the right phrase!

If a disqualification period ordered by the court has ended then it has ended. Unless a retest is ordered then DVLA does not determine when a ban expires. Revocation is not disqualification.

If a driving licence application has been submitted with the appropriate payment then, if it were me in this position, I would drive again.

In the circumstances described, I wouldn't expect it to be in the public interest to prosecute a driver for driving otherwise in accordance with a driving licence. Plainly, I'm predisposed to involvement in litigation and it's entirely understandable if others adopted a more cautious approach.

Is your MP aware of the circumstances?
