Walking along the High Street minding my own business and I bashed into some metal crowd control barriers a clothing store had put out to facilitate queuing. There was no one queuing in fact the shop was empty.

I fell quite heavily, cut knee, cut hand, shoulder bruised and of course it was a bit embarrassing.

After getting up I dusted myself off and hobbled in the shop ( big national chain) to ask to see the manager. No manager available but gave me the HO number.

What’s likely to happen when I call HO?

They'll direct you to Specsavers?

Joking aside, hope you're alright. Nothing will happen unless you make it happen, i.e. make a claim against them.

Was it public highway or private? i.e. are there markers in the footpath delineating a boundary.

Were you by any chance texting while walking?

What would you like to happen? If you can't see a fking great metal crowd control barrier, you are hardly likely to see a sign warning of "fking great metal crowd control barrier"

You could always try calling HO and ask them what's going to happen and then come back and tell us all - but you won't will you because;
if you call them they'll tell you to ps off and you'll look stupid
if you don't call them we'll all know you are trolling and you'll look stupid.

Either way - massive fail!

Good one! It was near Specsavers!

It was a High Street, on the pavement no markings etc.

What’s likely to happen when I call HO?
They will pass it to their PL insurers who will then ask them load H&S related stuff. As long as the store has been compliant they will tell contact you and tell you politely you don't have a claim.

Phone the local paper and explain the situation with them. Hopefully they'll come out and take a few pictures for an article.

Phone said store's Head Office and politely rant how your life has been ruined and ask them to think about the small children.

Maybe consider a letter to your local council too, get folk on your side!

Just get yourself nicked for doing 35 in a 30 limit. The Speed Awareness Course covers hazard recognition (don't ask me how I know wink ) so at least you should be OK next time

What did you want them to do?

Put out a sign saying watch out for the barriers (which you also wouldnt have seen)?

They will probably ask you for details of your public liability insurance, and if you dont have any, ask for and address to send a copy of the bill for damage to the crowd control.

However, if this is a serious post, you will need to make sure you attended hospital so that a medical report can be obtained, you will probably need to instruct a personal injury solicitor, and you will be asked alot of questions about what you were doing at the time to miss seeing a big metal barrier.

I’ve not phoned them yet, as to why I didn’t tell you - I’ve not told you the weather, the light level, my overall medical condition, my marital status blah blah.

There was a metal barrier on a public footpath. Whether I can see or not you can’t just put that there.
