Hi I went to look at a Boat in a boat yard and didn't noticed that it had parking restrictions until I had a ticket sent to me, so I went back to the yard to see the shop that sells the boats the yard had no parking payment machine or anywhere to enter you reg number outside the shop, it had a machine to enter your reg number inside the shop but at the time of the ticket the shop was shut so I had no way of paying or entering my reg number to avoid a ticket. The shop manager told me he would get the ticket cancelled so I went away and thought nothing of it , a few weeks later I got another ticket that had increased so I went back to the shop and was told that the ticket was cancelled and it was just a computer generated one so not to worry. Now after a few months I have a claim form from county court business center for £265.00 I have checked the company is legit and is endorsed on .GOV website so I assume I have to reply. I am convinced I have a legit right not to pay the fine it due to the only way to avoid a penalty was to enter your reg number into the machine but the only machine was in a shut shop. Also If I contest the ticket to the county court business center who arbitrates the ticket ?

Firstly, not sure if this applies when the ticket has already been progressed to county court stage.... so be aware.

Secondly, and retrospectively, the old policy of ignoring these private parking ticket demands is long gone..... nipping these bds in the bud is the best approach.

Do some googling, i’ve had 2 scenarios whereby i had parking tickets issued by third party private parking companies. I obtained, and amended, for my own purposes quite lengthy letters which had them crawling back into the holes they dwell in.

Find these templates online.... money saving expert is a good starting point.... draft a letter, call the parking company and go from there.

In essence, this is to do with implied contracts between you and the owner of the car park.... no contract exists....

who issued the ticket......? my guess is that it is someone at the boat yard. If they have withdrawn the ticket on the parking company’s website then the latter a simply chancing their arm.

eta - and if there was no means to enter your registration plate.... you have another ‘out’ there

Thankyou the ticket was issued by ANPR camera as no one was in the yard it was closed but you can drive in to look at the boats for sale, I will appeal on County Court Business Center website but who makes the decision ? does a magistrate look at the appeal ? or the company itself in which case they will reject it .

Is it Port of Wells by any chance?

Check the location where it was issued to see if it is covered under bylaws - easy defence if that is the case.
MSE or Pepipoo will have more in depth detail, I'm wary about I can post on here now!

A County Court is one of the courts that determines civil disputes. It is an independent judicial arm of the State. County Court decisions are made by Judges of various levels. In a case of this kind, the decision maker is an independent judicial officer called a District Judge. The County Court Business Centre is a centralised processing section of the County Courts system. Magistrates deal (mainly) with criminal cases and a few specialist types of civil case (not this type) in a distinct part of the Court system.

You are not engaged in an appeal system. A company has made a civil claim against you. You have the opportunity to oppose that claim. The court will decide the claim if it is not disposed of by withdrawal or agreement before the Court decides it.

It is saddening that basic stuff about the legal system that we live under is not explained to people before they finish their GCSEs.

it was definitely a boat in a boat yard and the boat house was lime green bouncegetmecoat

Yes indeed had a ski boat with a Black Max v6 2 stroke back in the day like chucking money down the drain novelty soon wore off, The boat I looked at was a present for the wife, I was going to Put on autopilot set to Newfoundland and set her off with a packed lunch.idea

Not in every case....
I had a Simms Super-V with a 1979 Mercury 70hp 2-stroke. Cost very little...In the 3 years I had it, it got a fair bit of use and the maintenence was cheap...
I re-wired the boat entirely (cost <£100 and a day's work) and repaired a few bits of hull damage at the cost of some glass matting, epoxy and flo-coat.
The only real cost was a new stator and regulator when the battery terminals jumped off in particularly heavy seas and fried the wiring on the ignition!

Even that was only about £300 all in.

Sold it earlier this year for 50% more than I paid, too!

I now have a Fairey Huntress and, so far, other than fuel and a few necessary safety additions, it hasn't cost anything other than the mooring fees.
I do expect to spend a little on some light renovation and maintenence in the winter (anti-foul, anodes, teak work restoration, cabin beading and window re-seal, etc), but am reasonably confident that it will not loose much (if any) value over the period of my ownership.

Boating can be cheap fun...I also have a small inflatable with a 4hp Evinrude that is both a tender and a boat for beach days and an inflatable kayak for some exercise...

All are cheap to run with the exception of the fuel for the Perkins T6.354 in the Huntress!
