Just a quickie.. am about to post on Pepipoo, but thought I would post here first..
Was caught on Scamera last month in South Wales .. 68 in a 50.
Wrote a letter to Scamera Partnership asking for photo's to help me identify the owner. Posted this 2 days after recieving the origional summons.
Post office lost the letter (recorded signed for) and it took 15 working days to find out that was the case.
Since finding out the origional letter was lost, I have sent another letter, and paid to have it fully recorded and delivered next day.
This second letter should have arrived on the day before my 28 days were up.
I have no problem in accepting the points neither had my wife if we can identify who was driving.
What happens next ?
I assume they will send me a nasty letter, and I hope to beable to identify the driver.

Slightly confused... did you get a summonds or a normal NIP?
South Wales Scamera Pship are probably the most ineffectual organisation after the congestion charge possee in Coventry.
If you have kept proof of the recorded delivery letter first sent, then they can't do you for not replying in time.

I would wait for their reply. You've done nothing wrong so far and will either get a 'you didn't reply in time' (which you can prove is incorrect) or a 'the photos don't show the face of the driver' (cross that bridge when we come to it) or the photos themselves, which probably won't show the driver anyway.

Section 172 is adamant that reply has to occur within 28 days and if not then matter passed for process for failing to comply i.e. name driver. BUT-
where request made person shall not be guilty of offence if he shows either that he gave the information as soon as reasonably practicable after the end of the 28 day period or that it has not been reasonably practicable for him to give it.
(Ignored is the statutory defence of not knowing who the driver was etc. which has been flogged to death here and elsewhere)
By retaining the form the SCP have not been able to make a Conditional Offer to the offending driver which if not accepted and no response in 28 days, matter passed for process. SCP can extend the 28 days in their Conditional Offer.
As to what SCP will do is anybodies guess, hopefully they will play ball and give the detail wanted.Once a driver is ID to let them know and CO kick in.

Well, got home this evening, photo's have arrived. Not exactly the clearest of pictures, three in total, but on the last one, the outline looks more like me than the wife. Not conclusive, but using a bit of common sence, it must have been me then.
Do the photo's have to be crystal clear ? these are very blurry, there are no distinguishing features visible, just that my head is obviously fatter than the wife's, so it must be me.
