TPS light ... MOT fail? law changed?

A year ago we had a car pass MOT with a TPS light on, it was only an advisory, is that still the case or is it a fail now?

Think TPS is Tyre Pressure monitor system

For vehicles first used on or after 1 January 2012, a TPMS light which is obviously malfunctioning is a Major defect and will result in a fail.

The inspection of the tyre pressure monitoring system (TPMS) is for M1 vehicles first used on or after 1 January 2012.

The TPMS warning lamp can operate in many ways depending on the vehicle type. You must only reject vehicles if it’s clear that the lamp indicates a system malfunction and not simply indicating that one or more of the tyre pressures is low."

If the vehicle was first used before 01/01/2012, the TPMS is not a testable item.
