SP30.. to count or not..

SP30s are valid for 3 years in terms of counting them. You have to wait 4 years to have them removed from your driving record, something I have never understood. Therefore you will only accrue your new 3 points to any points you earned in the last 3 years.

The reason is because points are counted for 3 years from date of offence to date of offence. However a court might be dealing with you several months after your latest offence. So it needs to know how many points you were on at the time of the most recent offence - ie points from three and a bit years ago may be relevant by the time you get to court.

Time runs from the date of conviction for the earliest offence to date last offence was committed
A ban is always discretionary and old offences always show up on the court computer which has access to dvla

Provided the time calculation is ok and it’s within the definition of minor speeding ie under 50 in 30 the plead guilty in writing and you’ll just be one of hundreds going through the mags and just points and a fine

Wrong. Oldest offence date to latest offence date.

Not conviction date!

A fixed penalty does not involve “going through the mags” or “pleading guilty.”

A fixed penalty is an alternative to prosecution.

I don’t expect you to understand it but see s.29(2) RTOA 1988.

Of the following:

- offence date;
- conviction date;
- sentence date;

only the offence date matters. Not conviction. Not sentence.

Evening All - I have 9 points on my licence, 3 x SP30's @ 3 points each. Two of these endorsements are now expired and have another few months left before they get removed. So in effect I only have 3 unexpired points.
Here's my question : Stupid git me got another SP30 last month and Im bloody so annoyed with myself BUT if I plead guilty and take another 3 points will they take into account & disregard the two expired 3 pointers as they have expired, or just add the new 3 points to the un-expired remaining 3 pointer?
