Failing to comply with restrict on vech entering a ped zone
Discussion
Hi All,
Thanks for responses in advance.
I’ve been a victim of Croydon Council’s s
tty way of raising revenue.
I got ticket for driving down the one way part of Hailing Road at 15:54, the advance signage was obscured by a tree and is also at the height of double decker bus.
.
I did appeal against the PCN however they rejected it, stating that they did not have to give prior warning and that was not an excuse
I have driven back along the road and have noticed that they have trimmed back the tree

They claim below is the sign which states the rules, but once you turn on here it's too late they have snapped you!

I am going to appeal, Is there anything else I could add to support my appeal?
Cheers
Sunil

Is the first picture your picture? Your dash cam video? Google Streetmaps?
The first two would seem pretty strong in terms of evidence, and the latter if it is a recent drive-by.
You could FOI the council to ask for a record of tree cutting work that has taken place in the street/area, on the basis it might prove it was only recently cut back.

First two pictures taken by myself on iPhone.
First picture after receiving the original PCN, second picture taken post their notice of rejection!
Third picture is from their rejection letter.
Cheers

surely this is one example of many that should indicate to everyone that the best policy is to totally ignore the FPN. Let the council jog on. Just imagine if the tables were turned. The council would be jumping up and down highlighting the hypocrisy of the action of pruning the tree. Where is the justice in all of this. The simple answer is justice doesn’t play any part in this process. This is simply a money making process and given that I certainly won’t play any part of it.

I think ignoring FPNs from the Council is significantly more risky than ignoring FPNs from PPCs. citychap26 said:
The fine is £65 if paid in 14 days or £130 after
That sucks, but if I were you I would pay that £65 now. On a paper you are right, the sign was obstructed and it would be very hard to read unless you were standing right next to it. However you're dealing with council and from my personal experience I know that they will do everything they can to frustrate you and make you pay.65 squids are not worth your time and stress.

I think ignoring FPNs from the Council is significantly more risky than ignoring FPNs from PPCs. It's funny isn't it, there is a no motor vehicles sign with a "except for access" exclusion under it at the end of my parents cul-de-sac.
It is utterly unenforced by either the police or council.
It's a parking free for all with commuters parking on verges and over people's drives.
No amount of complaints have ever seen action in the 30+ years they have been there.
I was told by one copper the sign means nothing.

Well the sign doesn't mean nothing, if the proper stages have been completed for it to be there. It is utterly unenforced by either the police or council.

Whether the council choose to enforce it or not is down to them.
Can't see how you can have any defence for that you can see the no motor vehicles sign clearly in your picture before you turn into the road so even if the no left turn sign was obscured you should have seen the restriction anyway and they've even angled the sign towards your direction of travel
