Scotland's Simple Procedure (small claims) in the Sheriff Co

Anyone put in a claim against another party using this? Are the forms and the process fairly straightforward or is it advisable to get legal representation, or at least legal advice in submitting the claim initially? Guess it might depend on whether the other party is defending themselves or not?

we've got one ongoing currently -all online - the lady at the court was very helpful with any queries and now claim has been submitted and issued to defendant the court has set a date later this month for a telephone based review and has urged us and defendant to either try and settle it before then or at least to agree what elements of the claim are not in dispute - so far Scottish court system user friendly

Thanks, that's useful to know. If it does get to court could you update your experiences so I might know what to expect? The form itself seems straightforward and so does our side of the case so the submission probably isn't the hard bit.

now resolved in pre court hearing hosted by sherrif - she was very very focused and direct - indeed we not convinced she had read ours or defendants submissions but in essence said if we could not agree it in this telephone conference she would schedule it for formal hearing in the spring but made clear that there was no certainty that interest would be awarded nor any of our claim for our time bringing the matter to this stage - in the end for host of reasons we agreed to accept an amount offered in this call by the defendants (a car dealership from whom we had bought an "approved used" car ) - glad to have it done with !
