Cruise control, a hill and a speeding ticket - WWYD

Happily and Legally cruising through some 40mph roadworks this evening, a road I know quite well but not with the temporary limit or the cones everywhere.
I was being a very good boy so I set my cruise control to 40mph so I needn’t worry about speed and sat back and chilled.
Surprised somewhat when the car in front of me and then 5 seconds later me both got flashed by a temporary speed camera
About 4 seconds after the car in front got flashed and I had processed what it was I glance down at my speedo and I was going about 46mph, but the cruise was still set and showing 40, but too late to brake
It was down a hill, and for some reason this stupid Skoda seems to allow the car to “get away” from the cruise control speed down hills
My last 2 cars would break to maintain the cruise speed
So, I wasn’t speeding, just my car was
I’m guessing no comeback, the car was speeding so the police will be right to ticket me, and it’s not as if Skoda are going to take my points and pay the fine, but I’m mighty pissed off!

Cruise control should, and I quote “ Cruise control is a system that automatically controls the speed of a motor vehicle. The system is a servomechanism that takes over the throttle of the car to maintain a steady speed as set by the driver”

I'd be amazed if you were doing 46 if that was indicated, pretty much every vehicle I drive overreads the speed.
You might be lucky and be within any allowed tolerance. But then again, maybe not.
We have lots of those interactive signs in my area that tell you what speed you are going and give you a smiling face if your being good, at 40 on my Speedo in most of my cars the signs report 36 ish. At 30 on the Speedo it's mid 20s.
Have you got a sat Nav or way of testing the Speedo to actual speed ?

trouble is that its a cruise control - it will control the throttle and the speed of said vehicle.
trouble is as you have found out the cruise can not control the effects of weight and gravity....unless it can brake aswell...
this is normally called cruise with brake function which is totally different - if the car had adaptive cruise then it may well have brake function inbuilt but not for simple cruise function. It depends on the engine braking to slow and maintain the set speed - so with hills it will run away if the weight and gravity overpower the engine braking effects.

No
No mention of brakes, just throttle in the above.
Basic cruise won't brakes, active cruise will brake for you going downhill, radar cruise will do both and maintain a gap to the car in front and may also bring you to a stop.
Seems you have basic cruise control
No wind up, just my last 2/3 cars would brake to maintain the speed set, and they were older cheaper cars, my fault for not realising that wasn’t a standard thing I assume, this car is top spec and only 2 months old so I a) wrongly assumed it would do the same, b) only just found out the hard way it doesn’t

From memory every car I’ve owned with cruise control it holds the speed and uses the rear brakes (that’s how it feels) to slow it in situations of going down a slope.
However 1 car that we own that doesn’t do this is our current model SMax. It’s the only car I’ve ever had to do this and evidently is much newer than previous cars. It’s actually pretty annoying

I would expect a 2 month old top spec Skoda to have ACC / auto braking / collision avoidance to be honest. Ho-hum, let’s see what the postie brings!

Regardless, still zero come back. Police won’t care otherwise everyone could use the same excuse.
Skoda will tell you not to rely on driver aids and to pay attention.
