I'm sure this has been covered before but have been told today that this is perfectly legal, by two PCSO's.

Trying to help out an elderly neighbour who has had an accident-damaged Fiat Punto dumped in the turning circle near her house, making access difficult. Car has been there for two weeks and is showing as uninsured in Askmid. Its taxed and MOt'd til Jan. Now she knows who it belongs to, youn woman who crashed her previous car shortly after learning to drive and left it there for three months. Seems she has done it again with her latest car. She has bought another Fiat and is driving round in that.

Police 101 actually told us that it is legal for uninsured cars to be parked on the public road if they are SORN'd. When we questioned this, they sent 2 PCSO's round to her house to look at it who told her it wasn't their problem if it wasn't being driven. She has to contact the council and have it moved. 101 also claim they have checked on 'their' computer and it is showing as insured. Which we doubt as the owner cannot afford to get it fixed, and for some reason hasn't taken the insurance payout which is a bit suspicious.

So are they wrong? Want to be certain of our facts before we call them up and ask them to come back.

You say it's taxed and MOT'ed. The Police say they have insurance details recorded.

What do expect to happen next?

So it’s ok for you to (definitely) break the law checking the vehicle on askMID but it’s not ok for them to (possibly) break the law on parking a (possibly) uninsured vehicle…

OP come Jan when the tax & mot come up it will no doubt go off to the great garage in the sky and the matter will be resolved.

I'd be patient and not break out the matches just yet hehe

If it is SORN’d (easy to check) then it cannot be on the public highway. It’s the OR bit of SORN that is important.

Thanks. Previous car was removed by the LA as it was leaking fuel into the road. Owners the typical sort who doesn't care and just buys another scrapper to drive round in.

Unfortunately when you talk to an untrained phone kbod on 101 this is what you can get and much the same goes for some but not all PCSO’s.
Parking an uninsured car on a public road is illegal and carries the same penalty as driving it, no ifs or buts or middle ground. For 101 to say it’s ok if it’s sorned beggars belief, I struggle to believe they actually said that, are you sure you have not misunderstood them? Try calling them again and speaking to someone else

Is anyone else thinking what I'm thinking in respect of a vehicle leaking fuel being dangerous, being removed because of it and the OP wanting this gone?

Without tax the DVLA will send in their clamp team, which will be followed by the towaway team a fortnight later I think.

Notify them.

It is illegal to keep a SORNed vehicle on the public road. So, in effect, they are absolutely wrong. Any vehicle kept on the public road must be taxed, therefore cannot be SORN and must have insurance under the continuous insurance regulations.

What you have been told is incorrect, but even if they become aware of that it doesn't mean they will act on it.

While they may also be committing the offence of not having continuous insurance, it is little more than a slap on the wrist when compared with the criminal offence of using/driving a vehicle on a public road without insurance which is 6 points and a large fine and a lot of pain trying to get insurance after an IN10 conviction

thanks, thats what I was trying to check. Doubtful anything will happen but wanted to be certain of the facts next time it happens.

They genuinely did. I called back and asked for them to reply the call and contact me to confirm it. A police sgt called me back she confirmed that it was legal! I have her name but I really can't be bothered as its Cheshire, so no point.

Why is using askmid illegal?.

If it's purpose to check if a vehicle has insurance, then the OP's issue with this car seems to me to be exactly what askmid is for.
