Had an accident-other driver saying someone else was driving

Hi guys,
My wife reversed into a car queuing car while reversing out of a parking space in the High St.
Our car isn’t really damaged, have been able to polish it out mostly, so no real desire to go through the insurers to get our car fixed.
Other car (Mini) is quite damaged, will almost certainly need a new door.
The problem is that the guy who was driving the Mini is from Spain, driving his friends car and assured me he was a named driver on his friends policy. His friend was in the passenger seat at the time of the bump.
I’ve requested all relevant details to pass onto my insurers to let them deal with it but the guy won’t give me his name, only the name of his friend who’s car it is.
It seems he wasn’t actually a named driver and was technically driving an insured car, uninsured.
Where do I stand with this, and what should I do?

You are still liable, whether he was insured or not. It doesn't effect your position in all this at all. I'd just give your insurers the info you have, explain what you've explained here, and let them deal with it. If you want to settle privately, then the guy in the passenger seat, who is the owner, is all the info you need. Just pay him.
To me it sounds like two seperate issues.
If your wife was at fault then she (via her insurance) is liable for the repairs regardless of who was driving the other car.
If the other driver wasn't insured that's a police matter rather than anything to do with the accident. If you want to take that further then contact the police and tell them the other party is refusing to give their details
Obviously it would be different if there was any blame on the other driver.

If you aren't claiming but they are, maybe just get them to call your insurer direct. That way they can say whatever they like about who was driving. Presumably all you will have to do is confirm that the collision occurred, and there is no damage to your car. Then let them get on with sorting it out.

But trying to find a way to weasel out of paying for an accident she caused by not paying attention does? Whether the other driver was legal or not is irrelevant. Your wife is still liable and at fault. The driver could be uninsured, on the phone and pissed out of his head, your wife is still the one who reversed into them. Instead of moaning about an alleged illegal driver, (who was in queuing traffic per the OP), have a word with your wife about opening g her eyes and actually looking in the direction she is driving! She reversed into a big lump of stationary metal, ffs! Should she even be on the roads? 5 years 100 quid nonsense (you picked figures out the air) seems cheap for such negligence.
Imagine if it was a far smaller, squishier person she reversed into or over. Would you be annoyed if it turned out they’ve overstayed their visa for example, or should have been at home isolating for Covid for example. ‘Shouldn’t even have been there’ argument doesn’t wash.
‘Should have looked where she was going’ very much does.
Unbelievable just how selfish some people can be!

If your wife is an experienced driver with NCB the cost of insurance will go up a bit. It will also come back down when she earns more NCB. It won't jump up for 5 years.
