To cut a long story short, on Friday my estranged wife phoned up my insurer and tried to cancel my car insurance behind my back. Luckily, as the policy holder, they had to phone me up to confirm. Obviously, if she had succeeded in her aim, I could have been driving around without insurance with all the risks and possible consequences that entails.

My question is, did she commit a crime? Should I report it to the police? I will be speaking to my solicitor about this on Monday for some qualified advice, but I wondered what the PH mind made of it in the mean time.

As additional information, the car is registered in her name, which is how she tried (unsuccessfully) to justify to my insurer that she had the right to cancel the policy. I bought the car off her and paid off the finance, but she is insisting the car is hers and refuses to sign the log book over to me. Since neither of us seems willing to back down and relinquish ownership, I suspect this will have to be decided with the rest of the divorce settlement. She was also a named driver on the policy (up until Friday when I took her off following her exploits).

I’m sure some crime could be made to fit, but I can’t see that anyone will be actually interested.

However, bigger picture is that she is already pis sed at you enough to pull this stunt, where will she go if you antagonise her?

I’d have thought you need to keep as clear of her as you can - might not be satisfying but be rational.

Guessing you may have touched on the situation with the insurance company who could then note the account but whilst she can’t cancel she probably could complete a change of vehicle to achieve a similar aim.

On that note if they have online policy management that you use and she might be able to access or be able to reset the password I would sort that because otherwise she could change the car without any human oversight.

I agree with you, but unfortunately this is part of a pattern of behaviour, which has been escalating since we separated. I need to decide how long I let it go on for, as things will only get worse. At some point I will need to protect myself.

Shes clearly not well from what ive read in your other thread, so best to cover yourself.

How do you prove you own the car if the V5 is in her name and she’s not yet transferred it? She could say next that you’ve stolen it from her.

Register with the police is what I would do, if she has done this to cause you trouble what will she do next! very easy for her to phone the police and say she has seen you dealing drugs from your car or drink driving etc

V5 isn't proof of ownership. I presume he has bank transfers and emails or something.

And OP, given the pattern of behaviour seen in your previous thread, report this to the police, and document it with the courts; this isn't a 'give up and move on' thing, after everything you've been through over the last year, and the lies told, this is just another attempt to harass and hurt you.
Train her like a puppy; she breaks the law or tries to hurt you, there will be concequences.

Log with Police regardless. Her behaviour is concerning, and had she succeeded, you could have been driving round uninsured. Six points and a fine at a minimum. Had you had an accident, well. Log all concerning behaviour - it protects you to a certain extent, and if she carries on, it would strengthen your argument for a Non-Molestation order.

Log all future correspondence - communicate via text if possible so there is a log.

Don’t rise to any attempts to antagonise you (easier said than done).

Hopefully the above advice is not needed and it goes no further. Ex’s can ruin lives but they’re not all mental - but you’re best placed to be the judge of that.

I am no expert on this but I seem to remember there is a defence against no insurance along the (layman) lines of you honestly thought you had it but for some reason completely out of your control it wasn't valid. I remember it because it was to do with someone driving a company vehicle where they had asked and been assured that they were covered by the owner/HR. It then turned out for some reason they were not covered but because they had asked and be told they were they were found not guilty.

No need to sign anything on the logbook... As long as you have the reference number you can transfer it to yourself online

Be a tt. Leave the car in her name and acquire lots of parking tickets. As the registered keeper it's her problem to sort out. The V5 will miraculously be changed soon after.

On a more serious note ring 101 and speak to the police. Get it logged and seek advice. If things persist or escalate you have calls logged to show a pattern of behaviour if required for harassment offences in the future. It's just covering your back

Get clear evidence of what happened. You may be able to get the recording from the company.
I expect in her state of mind this will be a bit of a list and again do the same and get real prof.

Do not do anything back to her as that will end any chance you have.

Then make you mind up what you would like to happen. That may be everything for strengthening you divorce negotiations to getting a restraining order. Just don't go down revenge road, but what has been side below, how best to get clear of all this.

If she succeeded and you did get stopped would she be stuck on as the registered keeper for being prosecuted for allowing someone to drive a vehicle without insurance?
