Edit:

Unfortunate tale of scam motor trader selling dodgy motors and not accepting rejection under consumer rights act.

Now a police matter.

Nothing to see here, move along.

I'll be sure to come back later with updates, but shouldn't have details up here while formal things are in motion.

See section 20 (15) - it seems to be after they agree to refund but they could insist they want to inspect before they refund. so in a way get it off you first.

My question is, do they have to refund me before they collect?
They're evidently completely untrustworthy, so I'm vary wary of letting them take thousands of pounds worth of car off my drive with nothing back in my bank account.
.
With the shoe on the other foot, how do they know that if they pay first you're not going to hide the car somewhere and block their numbers?

I was hoping for a mutually timed exchange.

They come, check I haven't put the windscreen through and such, pay me then take it away. Much like buying a car but in reverse.

Suggest that to them - they might agree.

This. In this day and age it couldn't be easier, they come and inspect the car, then phone back to base and get them to make a transfer to you, it should be in your bank within minutes and away they go

OP out of interest if they have such a dodgy reputation, why on earth did you buy from them?

I read it that the OP is basing his dodginess assessment on this car being borked rather than what he knew beforehand. Could be wrong though

They don't have an apparent dodgy reputation, they've got many high end motors on Auto Trader, a six figure stock catalogue; and mostly positive reviews.

Their answer is still "take us to court", won't entertain a rejection at all. So now I'm enlisting solicitors. More of a waste of time and money for something they could very easily rectify. It's only a sale in reverse. Something I wouldnt expect is difficult on a sub £10k car.

The most unusual thing about their response is that it'll just cost them more in the long run. (unless they disappear completely, which I'm now dreading).

Last week I bought a very tidy car, looks nice, drives nice. Unfortunately, it drank 2 litres of oil on the way back to Nottingham from London.

Oh dear.

Local garage today has confirmed it's totally borked and it wants a new lump or full rebuild.

Why are they refusing you refund?

Do they disagree with your local garages opinion?

Did they agree to you getting it inspected independently?

It's odd that such a dealer you describe would simply say "take us to court"

Not sure it's odd - just brinkmanship. They hope the OP is bluffing

What has the garage offered? To collect it, try and repair it and return? But you want to reject it? Garage has said, "Take us to court"?

OP the best thing you should do now is take it for an MOT to prove it's a failure a week after you've bought it.

Dealer could question your local garages diagnosis, will be more difficult for them to do that if you have an Mot fail from a different garage showing the emissions you describe.

Following consultation with my solicitors they've actually been naughtier than I first realised.
The matter is now in the hands of my bank's fraud department, trading standards and the police.

So I'll leave this thread cold for a while and update upon eventual resolution / non-resolution.

Could everyone please keep their fingers crossed for me?

Pity the OP has deleted and edited the original opening post, so the thread makes no sense now.

(Also disappointing that yet again, the first person to reply didn't quote the original post, so it couldn't disappear, turning this into a meaningless thread)

Or, it's down until there's some progress, then I can put the content back.

Once it's back up, I'll be sure to include all legitimate facts related to the thread for everyone to see. Not the most clever thing to do during an ongoing legal issue though. Unfortunately, threads from Pistonheaders have turned up in court during an ongoing case previously.
