Possible DWDC?

Hello all, I’m after some advise please.
I had an incident on Saturday 26th March, where I was pulled over by a police officer for going too fast while having another car up behind pushing me on who also got pulled over, he first saw us coming from the other direction, and radio’d to another police officer 200ft up the road parked on the verge, who then pulled out and pulled us over, he claimed i was racing, but in the end told me I had a section 59 and DWDC.
He didn’t give me a verbal NIP on the roadside, and it’s been over 2 weeks since the incident, would i still get a written NIP or would i have to wait 6 month for a summons? He told me on the roadside that i would get a letter within 2 weeks, my previous history is all clear because i’ve only been driving a year.
He let me go after around 5 minutes, and after another 20 mins i came back to the scene and the car behind me was still there, so i assume he might have got a worse punishment?
Will i still receive a NIP since today is 16 days, or would it be invalid?
Does anyone have any experience with a DWDC?
He said that i could lose my license and become a learner again, which would be devastating as my job as a Funeral Director very much requires a license, i was just finished doing a police callout on the way back from this incident.

Another question, would i have been given a piece of paper for the section 59? As i didn’t get one.

A speeding hearse sounds like great material for a Benny Hill/Dave Allen TV sketch.....but you are probably too young to remember them.

As I am a TVR owner and a serial trackdayer, I must say you sound like just the man for my funeral when the time comes.
Good luck with plod - sorry not to have a clue what the answer is.

I think when a verbal NIP is given they have 6 months to lay charges.

As you were spoken to at the time the 14 days thing is out of the window. That's only for when you aren't stopped at the time of the alleged offence.

Did he give you any paperwork? Did he say he was reporting you for DWDC or just warn you about it potentially being seen as that and then issue you with the Section 59 notice?

Edit: (since you're worried about it) If you are being reported, I'd have thought it more likely you'd either get 3 points or be offered a course unless there's more to it than what you're saying.

It's a 3-9pt offence but it doesn't sound like it was at the serious end, from what you've said...

Where you cautioned/reported for anything? Normally you are reported for the consideration of xyz. You do not have to say anything but it may harm your defence etc etc.

If not it’s unlikely you’ll get anything now. Properly just a warning.

If you did have that said to you then you’ll get something in the post. You may get a course.

My son copped one a couple of years back. Just thought hed had a warning from the officer - received the S59 in the post a few days later

How is the warning given and where is it recorded?
The Warning must be given verbally. Suggested wording can be found on the police national Database. See (Useful Resources). The warning should be supported by giving the driver Form 4742 Warning Notice, at the time of offence.(Form 4742 is not available in electronic format but is orderable through stores) The driver's name, the date of warning and officer's details should be written on the Notice.
Warnings are valid for 12 months from the date of issue and must be recorded on the Police National Computer.
The PNC report should be cross-referenced with a CAD entry. The text should include full details of the person upon whom the Notice was served, reporting details, where the supporting evidence is retained and details of any proceedings undertaken.

Sounds like you will be getting a summons for DWDC, if you get 6 points on your licence from it you're back on the bus. You need to write down what happened including the lead up to getting stopped so you can put forward any mitigation as it might just help save your licence.

As for the Section 59, getting your car back can be expensive.

Last question, what have you learned from this?

Unfortunately any form of racing is taken seriously by the courts. They don't often charge the specific offence of racing because it's a tricky one to prove. However, if the rozzers do proceed with a charge the "evidence" may tilt things towards the more serious end of Careless Driving. (Dangerous Driving, if charged, is a more serious offence.)

Tough break man.

I've been driving for a fair few years now and I've gone from that age of racing and getting influenced by others to instead, if I get someone up my rear, I'm pulling over and letting them go by. 9 times out of 10 you meet them at the next set of lights. It helps driving a big ol' yank tank and takes a while to get the momentum going.

I didn’t know the driver behind, which i believe helped my case in this situation.
I’m led to believe that him informing me of the DWDC is the verbal NIP. I assume this means i won’t be getting a letter even though the officer told me i would, and that i will now have to wait up to 6 months for a FPN or summons.

As I posted earlier...did they say something similar to 'I am reporting you for the consideration of the question of prosecuting you for the offence of...' and then where you cautioned? 'you do not have to say anything but it may harm your defence etc.'

No he didn’t say that
