Unless she was fiddling with her phone while the car was moving slowly (in which case it would be harsh but technically correct). the police have got this one wrong. She should decline the fixed penalty and send a letter pointing out that her use of the phone was covered by a specific exemption, which will hopefully ensure that she doesn't end up having to go to court once it's read by someone with a clue.
This assumes that her story is accurate if course - young people who are in trouble with the law don't always tell their parents the whole truth about what they did so it's always possible that she was doing more than just making a contactless payment.
