Time from NIP to Next Step

I was pulled over for speeding in early February this year, 49 in a 40. Yes, i know very stupid, and keeping speed down now.

I came over the top of a railway bridge, there was a police van at the bottom with a speed camera and they spotted me easily.

There were two police in the van and they went through all the paperwork and gave me the NIP document. All very polite and about as pleasant as it could be in the circumstance. I was told I would probably be offered a speed awareness course and thought that would be fine.

Anyway, that was just over six months ago and I have not had any further correspondence on the issue.

Is there a time limit on how long the police can pursue this? Could I still receive the speeding prosecution/speed awareness course?

No chance of speed awareness course offer after 6 months. At 49 in a 40 you would have qualified and ordinarily been offered one assuming you've not done one of the same type in the last 3 years.. have you?

They have 6 months to lay it before the court, and apparently often use pretty much all of that time. How early in February are we talking? It's only 8th August, so it could in theory be in the post.

Might be worth checking your licence online as well just to make sure you haven't somehow ended up with points on there without your knowledge.

What did the Occifer actually give you? Can you post a copy washed of your details
49 in a 40 is quite a low speed to get a ticket from a stop, would quite often be a flea in the ear and told to slow down, unless of course he didn’t get any the night before. Maybe you passed the attitude test and I bet you’ve slowed down. As said above, check you haven’t been convicted of an offence in your absence,

Were you driving a minibus or something? SP40 seems like the wrong endorsement.

Doesn't the SP40 bit relate to the speed involved?

A passenger vehicle is defined by the DVLA as a vehicle which has more than eight seats and depending on weight and length have different speed limits.

Both look about the same to me! But that what the .GOV website says.

Perhaps that's why it didn't proceed further because they realised they'd ballsed up the ticket.

I think you might be fine as the ticket has been written to an 8 seat vehicle but with your reg number. So at some point it has been sent back to be rectified.

Whoever had that job has decided it is less hassle to file the paper. Maybe there was indeed an 8 seater in front of you and they have stopped the wrong car. (So they don't want that fight?)

As it is unlikely they'd take you to court for this speed, you should be fine. If you are worried it has gone to court then they must have sent the paperwork to the court by now (6 months from date of offence) and I although I'm not sure how you do it, there is a way to check if this has been done.

If it has not then you really can relax. You can now too, methinks.

A TOR doesn’t have to be “rectified.

Well nothing in todays post so, as you say, fingers crossed!

Perhaps I did pass the altitude test as they seemed quite relaxed. They didn’t even get out of the van - we pulled into a car park and I walked up to their window. All done from there.

Are your address details on the paperwork correct and did you do a licence check?

Yes, details all correct on the paperwork. As said above, checked my licence online yesterday and no points showing.

Just to be clear, I am not looking for any defence and I'm happy to do the SAC/take the points and fine if need be.

My main question is about the 6 month period. Is this relevant to this now going any further or is it 'time barred' or whatever the legal term is?

If so, I can put it out of my mind.

Far too late to do a course, so forget about that.

The deadline to commence proceedings is 6 months from the index offence. If proceedings have not been commenced then you're in the clear. If you want to be sure then email the relevant police prosecutor.
