Have just received a Notice of Intended Prosecution after a dreaded double flash from a gantry camera on the M4 (Speed reductions were in place due to a lane closure further along the motorway) I passed under the camera at 48mph. The notice states the limit was 40mph. However I and particularly my wife, are normally very 'alert' to such warnings and I purposely slowed down on sight of the gantry from 70mph to 48mph as we are both sure the limit displayed overhead on was 50mph? Admittedly subsequent gantry's as we got closer to the lane closure were displaying 40mph.
Is it possible that the display was out of sync with the camera? Does this ever happen and if so is it worth mentioning this when returning the form? I am not questioning the 48mph just asking whether any other 'speeders' caught by the same camera had the same question? (Cars either side of me were also flashed at the same time)

Any advice welcome...

Invest in a dashcam!

More helpfully, I understood that these gantries have a camera trained on them, producing an image of the speed limit sign showing the limit in force (together with the offender) when a vehicle is "nabbed".

If so, should this image not be provided for you?

Perhaps you ‘switched off’ after seeing the 50 sign. We have had dual carriageway works for a long time around here. The initial speed limit drops from NSL of 70, down to 50, and nearer the actual works to 40.

(Yes, they are actually working, some serious digging gear there, that looks as if it is about to swing into the road and take your roof and head off!)

Have you asked for photos or viewed them online? There will be an image showing the overhead limit displayed at the point you triggered the camera. That is what the pole with the 2/3/4 grey cameras a 100 yards before the gantry are there for

Out of interest: does anyone know what the timeframe is between a sign changing the speed . . . and the camera enforcing it?

I assume (perhaps dangerously) that there is some common sense, and if I am about to pass under a 60 limit (at 60) and i see that change to 40 im not expected to chuck an anchor out of my car to meet the new speed limit within a few yards of the gantry?

In addition to this: when the OP gets the picture clearly showing it WAS a 40 . . . does the OP also get proof from the enforcement folks that the gantry had been at 40 for more than the (assumed) 10 seconds? If not, OP might have been 'caught' by a gantry that had literally just changed?

Good point.... I'll let you all know once I receive the picture. Might have to end up eating humble pie but there you go....

The two statements do not contradict each other.

The statutory period from the point a lower limit is indicated until that limit is in effect is 10 seconds.

When enforcement commences following that limit change (which clearly cannot be within the first 10 seconds) is discretionary.. The claim from Auto Express is that this is 60 seconds. Personally, I wouldn't want to assume that was the case across all areas.

What's the statutory minimum for speeding on the motorway? And what's the point where enforcement starts?
