I'm questioning this. Smacks of a bit more than 41 but told there's no tolerance in Somerset and Avon.

Not me but a relative adamant it's the cars fault... They've actually replaced it to prove the point! Personally I think it was probably 45+

I thought it was a fairly simple question. Are you actually going to get done on a camera doing 41 in 40 by Avon and Somerset police.?

Elderly relative set the speed alarm on tgeir new car says it didn’t warn them so changed the car rather than admit they were speeding.

If you are going to be silly about it don’t bother posting. You just look stupid.

No, you won't get done for 41 on a 40. Your relative is almost certainly lying about how fast they were going out of embarrassment.

The nonsense about replacing a car is an extreme reaction to save face. Very odd

Looks like your relative is going for two lines of defence - claiming to have only exceeded the speed limit by 1 mph, and blaming it on the car at the same time. It would have been more convincing to pick just one.

So he's got the NIP for 41 in a 40, and been offered/accepted a SAC? As above doesn't sound likely.

Or is he panicking because his new car somehow told him he'd gone through a speed camera at 41? So he sold said car.... (eh) In which case he'll be fine as he should not even get a NIP for that.

More likely to have set the limiter at 41mph, but posted signs changed from 40 down to 30 without them noticing.

There have been a number of cases on here over the years of drivers claiming to have been prosecuted for 1mph over the posted limit but nobody has ever provided documentary evidence. If your relative really was doing 41mph then they’re safe.

Most likely got caught at 48mph and "knocked off" the 10%+2 as well?

They are talking crap, no region in the UK enforces a penalty for 1mph over the limit. Imagine the average car dashboard - given the scale could you tell whether you were doing 39, 40 or 41 mph with any certainty?

In any case, it's 10% +2 in A&S as most counties so would ask to see the NIP if they stick to the 41 in a 40 claim!

The point is there's absolutely no way they would get anything - whether an SAC or anything else - for 41 in a 40.

People come along and say that XYZ force use zero tolerance or are adamant that they, or someone else, got a ticket for 1 or 2 mph over the limit but it's never the case.
