Hello,

I need some advice on what to do here.


I attended a cousin’s wedding in Richmond in June 2022, and parked in a council carpark and paid appropriately, but was given a Penalty Charge Notice by some idiot warden.


As I didn’t commit an offence, I contested the charge, and it was cancelled in both a written letter and an email. I received no further communication from them.


I sold the car (Volkswagen Polo since this is PH) in August 2022.


On 23 January 2023 my parents received a letter advising that I had a warrant against me issued by a county court for bailiffs to come on behalf of the council and that I had a final 7 days to pay a massive charge or face them. I live in Manchester where I attend university so I had no idea of this as my parents don’t open my mail, but don’t worry it doesn’t matter as I will get down to it below.


2 days later, another letter arrived from a previous week advising they had the judgement and to pay up again (bear in mind I am in Manchester right now so don’t recall exactly what it said)



So I contacted the line last Tuesday and they wouldn’t put me through to anybody, but said they could pause proceedings for 7 days.



Today (more than 7 days later) they contact me again and advise me that they will not cancel proceedings due to a “different PCN number being given to them” and that also my evidence from Richmond council is invalid because it was from before the 18th January and regarding a different PCN . Well of course it was you s it had happened ages ago?? I don’t know what they’re on about talking about regarding a different PCN because like I said I only received 1 ticket, and I got one PCN.








What is my best of course of action? This is the first time I have got into a parking issue. I can’t and won’t pay this scum company fees for something I didn’t commit.. both them and Richmond council won’t play ball. Any advice?


ETA: I don’t think it would be the new owner, who does live fairly nearby. It wouldn’t make any sense anyway as I sold the car last August


ETA2: the distance between me contacting them and them sending the letter is due to my mum never opening any mail whether its mine or hers. So irritating and an awful habit. Stuff like this gets worse because of that

Take it to court if everything else has been exhausted. Contact the court and ask for the judgement to be set aside.

This. You need to download and fill in form N244. I think the fee is £275, but this can be waived if you are on certain benefits or on low income. It may be that you have to hand the form in to the Court Office and talk to them about waiving the fees and bringing in ID. You will be applying for the judgement to be set aside as you did not receive the ticket. I would also ask the Council for a copy of the ticket and any photos. Was/were there other occasions when you may have parked there around the time of your other cancelled offence. If so, you may have to pay at least a £60 fine.

I called the council again today as a last resort before I have to go to the court.

They said to send the previous letter back to them and wait 7 days while they work out the issue. But they won’t pause the enforcement agency’s proceedings. I might call them now again and get it paused.

They also said they sent correspondence addressed to my mum (the keeper) with threats from July - December 2022 and clearly my mum did not open a single letter


My mum has completely screwed me over. I am fuming at how she couldn’t open a single letter addressed to her. When I called her today she put the blame on me instead, saying that if I just paid the parking charge to start with this problem wouldn’t have started! WTF. Why would I pay something that I shouldn’t have received in the first place?

Clearly my case is looking a lot weaker as a result of this

I will have to pause court proceedings if RC and the enforcement agency don’t listen to this last resort

I’m fking confused now..

They said that I have TWO PCN’s for the same thing? One was cancelled and the other one was live. What a load of bks. I only received 1 ticket.

Your mum will be delighted that this is the way you feel about her. It won't help your current situation but in the future you could perhaps try taking responsibility yourself rather than relying on an older family member. Just saying...

First of all, none of the letters were addressed to me, so I wouldn’t have opened any of her letters.

Second I took the “first” PCN and cancelled it immediately, on the same day, so is it not unreasonable for me to not expect another PCN charge.

Third don’t you think it is ridiculous that someone would have missed 2x letters a month addressed to them marked “CONFIDENTIAL” for several months..

Fourth she opened the letter from the enforcement agents in January yet didn’t think to tell me about it until several weeks later

Fifth don’t you think it is a bit ridiculous that I have to do basic tasks for her when I live on the other side of the country.. car insurance, home insurance, arrange new phone contracts, filling in job applications, arranging HER holidays. Only yesterday I even applied and sent her passport application because she couldn’t be bothered to do it herself. Don’t you think that is even one bit ridiculous for someone who is physically and mentally able and able to use a computer. I have been doing this since I was 11, this one is the one that is the final straw

Thankfully, I am now the keeper of my current car, but that doesn’t mean that this problem will ever happen again as the car is registered and parked 200 miles away..

Think I need to relax because currently am incredibly tense! I hope if this goes to court I win because currently I don’t have the funds to pay the extortionate costs

I might have missed something but if there is already a CCJ doesn't that mean that it's already been to court and they have found against you as it was undefended?

The letter only said that there was a warrant against *my mum* (the registered keeper of my old Polo) issued by Northampton County Court

The letter only said that there was a warrant against *my mum* (the registered keeper of my old Polo) issued by Northampton County Court
Fairly sure the J stands for Judgement - in which case they’re enforcing the judgement that’s gone against you. Or is it your mum? But confused on that aspect.

My dad got the Polo when I was 16 turning 17 so it was registered in her name, as my dad doesn’t live at my address.

When I purchased my current car (for myself) I made sure it was registered in my name to prevent any issues.

Technically, all of this is against my mum, as she was the keeper of the vehicle (I explained why in another post). Sure, I could be a prick and let her deal with it, but as I was the main driver, the insurance policyholder (not relevant) and the driver of the vehicle at the time. No matter how many times I have explained to LBRC that it was me they still keep addressing it to my mum. And the enforcement agents.

Nightmare situation.
You need to find all relevant letters and sit down and chronologically work out what’s happened. If your mum now has a CCJ it really does affect many things for a considerable time. Have you definitely got the email from the council cancelling the original penalty? Is there absolutely no way another one may have happened which is what they’re chasing?

While I understand your frustration try not to let it get on top of you mate.

Worst case scenario you are going to lose a couple hundred £ here.

Practicality wise maybe try and keep stalling till you get the money asap. Or ask for a realistic payment plan as you’re a student.

I don’t know the ins and outs, I have only seen 2 letters, both from the enforcement agency. Those are the only two letters they sent. my mum claims to have seen no letters from the council and she doesn’t know where they are.

The letters from the EA said, as a summary:


LETTER OF ENFORCEMENT ACTION AGAINST YOU

We have got a warrant against you (mum) from Northampton CC because you didn’t pay the council when they sent warnings against you.

Pay this sum (£XXX) NOW or face the bailiffs. We will take your stuff

You have up to X date to pay.

Call us if you think there is a mistake.


If you have paid, thanks.






When I asked her why she never opened them, she said she doesn’t like paper letters so hardly ever opens them unless they are clearly marked with something important.. At this point I went ballistic, obviously.

Who knows what else has fallen through the net so far.
