well its happened again , wife got a distressed call from her best friend , It appears she got into an argument with her husband and he then got in the car and drove off , was AWOL for 3 days by the sound of it , hes been on a mega bender , as she received a call from the police that he had been arrested for drink driving .

What an absolute bell end he has his own business , & Was done for drink driving 2 years ago , by all accounts he blew 105 this time so thats 3 times over the DD limit

So their car is now in our drive ,wife drove her friend and daughter to the airport shes going to stay with her mother in spain . his work van is outside their house , I know it would be a minimum 3 year ban , Is It likely he would get a suspended sentence ? due to the amount of alcohol , I've advised him to seek professional help regarding both solicitor and alcoholism any advice , would be appreciated.

Tell him to buy an ebike as he wont be driving again for a long time.

"If you have 2 convictions for a drink-drive offence in a 10 year period, you will be disqualified from driving for at least 3 years and the possibility of receiving a custodial sentence increase."

My friend was caught a couple of years ago, he should have been caught sooner! He was told it is more or less a certainty he will spend time in prison if caught again, don't know if that's a scare story the Police told to try and get him to stop. He blew 130 something which I think has a big impact on the punishment.

He hasn't managed to kick the habit so hasn't reapplied for his licence which is probably a good thing.

A community order is probably more likely than a prison sentence (suspended or otherwise). As you say he'll get a minimum 3 year ban. He'll also come under the DVLA's high risk offender scheme which means that even when the ban expires he'll have to undergo some medical tests to show that he doesn't have (or no longer has) a drink problem before he can get his licence back at all.

A pal of mine has done 4 stretches in prison entirely down to drink driving. Each time he was nailed again it was after a long ban. I'm not sure he lasted more than a few weeks each time.

I don't think he got any time to serve until the 3rd instance and then it was in the bag each time. All of them were rather heinous but no one was hurt.

After wasting 35 or so years and coming off his latest 5 year ban he's now finally sober but finding it very difficult to persuade the DVLA to give him a licence again.

I got a ban for drink driving many many years ago. 20 months for blowing just under double the limit. 1/4 off for attending a course.

The people on the course were a mix of two distinct types. Those who'd made one dumb mistake and those who were repeat offenders. One guy was apparently on his 9th time being nicked for drink driving and still hadn't been sent down.

I doubt he'll get locked up, but 3 year ban is mandatory.

Whatever the ban, he will probably not be able to get insurance.

There will be options available.
For example, he might get a silly premium but be able to afford it, or use a policy covering all drivers, or he might drive round uninsured frown

A ban of at least 3 years is mandatory. 105 in breath. Second offence. My money is on 42 months.

Most likely outcome is a medium or high level community order. Expect several RAR days.

He will get insurance easily, at a price. Plenty of specialist insurers for high risk drivers.

After 2 convictions it's probably better (for the rest of us) if any drunk is simply banned for life.

Somebody caught just over the limit, once, will probably learn to keep to soft drinks in future. A drunk who gets convicted twice [how many other drunken drives not picked up?] deserves to be taken off the road for good.

a 3 year ban for sure but at the magistrates discretion he will be given an option to got for an awareness course which will see the ban reduced by 25%,he will most likely get asked to do some work FOC and there wont be a custodial sentence

He will be able to get insurance again but at a higher premium

At least 3 years. Not likely to be offered the course if he did it only 2 years ago.

Probably offtopic, but for people who have such bans, don't they just wind up demostrating other poor judgement by driving without a valid license/insurance during the ban?

If they do then much easier to send to prison (goes for anyone driving when banned for any reason)
