Deposit put on a used car - gearbox issues - buyer's rights?

My son put a deposit down on a used Mini, sold by a dealer. The dealer then found the car needed a new gearbox, so wants to give my son the deposit back, stating they want to give the car back to the auction house they bought it from. What rights has my son for insisting they fix the issue and complete the sale?
Thanks for any advice.

Probably none, just be thankful that the dealer didn't continue the sale.

I suppose it makes a difference from people complaining about dealers that WON'T return the deposit!

The OP finds an honest dealer who wants to do the right thing, and he still isn't happy.
What is wrong with people nowadays?

Sounds great, take the money. You could try to enforce the contract but it sounds like you have a good dealer to work with so maybe see what else they can find him?

What's wrong with people? Clearly they have nothing better to do than make a useless retort in the vain hope they sound clever.

Got to be a wind-up. A dealer buying from an auction has little comeback at all with the auction house, chances of returning it are slim to none.

Actually, we rejected probably a dozen cars through BCA Assured over the course of a few years when I worked for an indie in sales. We often made successful claims for stuff missing from reports including accident damage etc. We'd either get a reimbursement or at times we'd punt the car back to them (it usually went back through)

It's likely they won't, we bought heavier prestige stuff, but it's not impossible.

Of course he has rights. Unless there is something any agreement signed, then the dealer is failing to honour a legally binding contract. So YES the buyer has rights in law.

However, in the real world, take the money and be glad that the dealer is behaving sensibly - so you should do the same.

Perhaps no problem with the car. Dealer found someone else to buy it at a higher price. Or a friend of the salesman wants it.

It's a Mini, DON'T buy it yikes

A friend has one & it needed ALL wheel bearings, discs & pads, radiator, AC was shot, umpteen stored codes for varying issues.

This is right up there with some advice I once received from an elderly relative: “Don’t go to Turkey”

“Why not?”, I asked.

“A friend of mine went there once, and they broke their leg while they were there”.
